Today, Tuesday, I met with Jane Dolan, Curt Joiassen,
Tom Parilo, and Stu Edell on the problem with CSA 90.
I had previously talked to Dennis Rausser and Dick Ramsey and got
them both to agree to install 3 fire hydrants, at their expense, on
the water main in the CSA if we (Butte County) accepted the existing
water system as is. The current owners in the CSA will still have to
have an election and approve an annual fee for the maintenance
expenses Mr. Rausser has talked to most of the other owners and
believes that there will not be a problem with the election. I talked
with the owners of the water system, Baldwin Contracting, (Rene
Veracruyssen), and he stated that he has all the information necessary
to deed the easements over to the County when we accept the system.
Jane Dolan was very happy with this and thought that it would help us
expedite the process. Mr. Rausser is in a time crunch to decide
whether or not to apply for a new 25,000 square foot building in this
area or look elsewhere. He has to be out of his current building at
the Chico Airport by April 1, 1998. The current building inside CSA 90
is not large enough for his operation and his expected expansion
needs.
Also to expedite the process Jane Dolan will have the acceptance of
the water system put on the agenda for the Dec. 9, 1997 Board of
Supervisor's meeting. Jane was also going to contact Mr. Rausser and
request that he get a list of signatures (at least 11, or 51% of the
owners) on a petition stating that they will accept a maintenance fee
at the election which will be held in approximately 2 months. Jane
also requested that the budget for the CSA be revised downward to more
realistically represent the current expenditures. I will work with
Public works on the budget. we will probably form a zone 3 inside the
CSA for the 20 businesses.
Andy wood, of North Valley Ready Mix, has quoted to me a price of
$2500.00 each for the installation of commercial fire hydrants. This
includes the cost of the hydrant, an 8" shut-off valve and the labor
for the installation on the current 10" water main. Mr. Ramsey said
that he would also investigate the costs involved. Because of the
un -developed roads to the best locations for the new hydrants there
may be some $ involved in access roads. Mr. Ramsey, who is in the
process fo subdividing his 25+ acres inside the CSA, will benefit in
the long run as he will be required to install hdyrants at the time of
development.

Prior to the meeting originally scheduled for 11112/97 we FAXED to you our comments and
indication of our support for completion and improvement of the fire protection system at
Southgate. On 11126197, Dennis Rausser called us here in Mexico to ask that we sign a petition
to increase the service chafe and establish CSA #90 Zone 3 for fire protection. Dennis'
description of what is intended causes us several concerns.
Dennis indicated that the plan is to Simply install 2 or 3 hydrants along the existing line. Inasmuch
as we have no fils8 here with us, we cannot determine if such an installation will provide a
hydrant sufficiently chose to our properties to comply with the County and (SQ standards, and to
qualify for an ISO rating of 4. Our properties are at or near the northeasterly limits of the
discussion area. Prior to agreeing to their inclusion, we will Head to be certain that the nearest
hydrant is within the limits for ISO 4 and Butte County requirements.
We also feel that the proposal to levy the special tax solely on the basis of number of parcels is
not equitable, and may not meet the Government Code requirement (do not have the Cade
available here to ate the section) that a special tax be apportioned on the basis of benefits
received, rust of making the services available to each parcel or other reasonable basis as
determined by the legislative body. We have prepared a tabut0on ghowing the total acreage,
the proportion represented by each parcel, the proposed annual levy and the portion of the telal
levy with which each parte! is charged. We assume thaE "parcel" means a parcel as shown on
the latest Assessor's Map and Roll. Our three parcels represent 4.86% of the tatel acreage, yet
the proposed annull terry against our parcels represents 14.289+6 of the total levy. Additionally, we
wilt enjoy no reduction in insurance premiums for the two unimproved parcels. At the other end of
the spectrum, Ramsey's parcel represents 42.61 % of the area, yet his levy is only 4.78%. Those

Another apparent inequity is the lack of participation in operating budget expenses by the
residents of Southgate Acres. The pump and distribution system benefits these thirty five or forty
properties, yet there is no provision for their abating in the costs of maintenance, utilities, county
services nor replacement reserve funds.
One last concern involves a comment by Dennis that one or more owners has raised the question
of replacing the retention pond with a deep well to provide not only fire protection, but e source of
domestic, potable water as well. If such an improvement is contemplated, and a method of
apportionment established on the basis of the number of parcels owned rather than on a benefit
basis, the magnitude of the inequity will be such that litigation wifl be assured.
We still support the concept of 8 viabfe fire protection water source operated and maintained at
the expense of those afforded protection. We flee[ very strongly, however, that the costs must be
apportioned equitably and shared by all who receive the benefits.
We will appose any attempt to increase service charges and to establish a Service Area based
upon an arbitrary and capricious method of apportionment which allows dosses of owners who
enjoy benefits to escape financial responsibility iur those benefits.
We sincerely hope that the matters we hove raised here can be resolved.

I think todays meeting was interesting. I think you heard the owner of
Rousers say he pays $4,000/year in fire insurance and is rated at an
ISO 8. Mr. Rouser and I talked to his insurance agent on the speaker
phone. A drop to an ISO 4 would save him 30 to 40% in fire insurance
cost. $1200 - $1600, that's a big savings!
I would develop the most logical plan for hydrants that covers the
improved parcels only. Send every person in area 1 and 2 a map for the
hydrants with a cover letter explaing cost to install plus the annual
maintenance cost. In addition we need to mention the insurance costs
with and without hydrants. You'd have to do some checking with the
residential homeowners to see what they're rated at now, and what
they're paying, and what they could be paying without hydrants.
We'll want to check with Dolan and Josiassen before we send anything
out.
