The Butte County Fire Department proposed budget for CSA 162 will be as follows:

This total divided by 17 parcels would result in a $176.48 per parcel annual
assessment for the fire department portion only and would not include anything for
drainage or street lighting. My contact with the homeowners group indicated that an
election for this would pass.
Any help in getting this CSA moving again would be appreciated. LAFCO
has closed out their file on this so a new application will be required by the owners.

Dear Gentlepersons:
Beverly Chambers, Lowell Pierce and Deborah Pierce have asked
that I contact you concerning the above-described matter.
Beverly Chambers developed the Chambers Subdivision, which
consists of 9 lots. The fire protection well and other fire
protection facilities for the two subdivisions sit on Lot Number
9 of the Chambers Subdivision, and it provides fire protection
water for both subdivisions.
Lowell Pierce and Deborah Pierce developed the Pierce
Subdivision, which consists of 8 lots. The Pierce Subdivision
.receives fire protection services from the fire protection well
and other fire protection facilities which is located upon Lot
Number 9 of the Chambers Subdivision.
THE PROPERTY OWNERS OF CHAMBERS SUBDIVISION AND OF PIERCE
SUBDIVISION HAVE AN OBLIGATION TO PAY THEIR PRO -RATA SHARE OF THE
OPERATING EXPENSES AND THE IMPOUNDS FOR THE REPLACEMENT RESERVES
FOR THE COMMON AREA FACILITIES
As you are aware, Beverly Chambers, Lowell Pierce and Deborah

Pierce have been paying the operating costs for the fire
protection facilities, landscape facilities and roadway
facilities, etc. for the Chambers Subdivision and the Pierce
Subdivision, respectively.
It is now time for the property owners within Chambers
Subdivision and Pierce Subdivision to commence paying for the
operating costs, repair costs and replacement impounds for the
common area facilities at Chambers Subdivision and the Pierce
Subdivision.
Effective January 1, 2001, Beverly Chambers, Lowell Pierce and
Deborah Pierce will no longer pay any of the operating costs, or
repair costs, or replacement costs, etc. for the fire protection
facilities, landscape facilities and roadway facilities, etc. for
the Chambers Subdivision and the Pierce Subdivision.
IT IS NECESSARY TO FORM A MANAGEMENT COMMITTEE TO MANAGE AND
OPERATE THE COMMON AREA FACILITIES FOR THE CHAMBERS SUBDIVISION
AND OF PIERCE SUBDIVISION
It is necessary for the property owners of Chambers Subdivision
and Pierce Subdivision to establish a management committee to
manage the common area facilities, establish the budgets for
repair, maintenance expenses, plus impounds for replacement
reserves.
Beverly Chambers, Lowell Pierce and Deborah Pierce have indicated
to me that, possibly, the following persons might be willing to
serve on a management committee:

10. A photocopy of the budgetary materials for
Durham -Dayton Industrial Partners for Extended Structural Fire
Protection, for Fiscal Year 1997-98,
MUTUAL GRANT OF EASEMENTS FOR FIRE PROTECTION FACILITIES AND
MAINTENANCE AGREEMENT AND OFFER OF DEDICATION
The "Mutual Grant of Easements for Fire Protection Facilities and
Maintenance Agreement and Offer of Dedication", hereafter, Fire
Protection CC&R's, was recorded on October 9, 1995,.as an
encumbrance upon the Chambers Subdivision, and upon and the
Pierce Subdivision, prior to the time that the fire protection
facilities were completed. In this regard:
1. Section 9 of the Fire Protection CC&R's provides, in
relevant part, the following:
"9. REPAIR, MAINTENANCE, REPLACEMENT AND OPERATION OF
THE FIRE PROTECTION FACILITIES:
The Fire Protection Facilities shall be repaired,
maintained replaced and operated in a good,
operational, workmanlike manner, free from weeds,
debris, or vermin, according to the operating
requirements of the County of Butte, and/or of the
California Department of Forestry."
2. Section 10 of the Fire Protection CC&R's provides, in
relevant part, the following:
"10. PAYMENT OF COSTS OF REPAIR, MAINTENANCE,
REPLACEMENT AND OPERATION OF THE FIRE PROTECTION
FACILITIES:
The costs of repair, maintenance, replacement and
operation of the Fire Protection Facilities shall be
paid as follows:
A. So long as the Chambers Property has not yet
been included within a County Service Area for the
payment of the said operating costs, the Owners of Lot
9 of Chambers Subdivision (as described in Paragraph 1,
and located within Chambers Property) shall pay the
reasonable and customary costs of repair, maintenance,
replacement and operation of the Fire Protection
Facilities, subject to obtaining reimbursement of said

costs from the remaining Beneficial owners, as follows:
a. Upon demand, each owner of a Lot within
Chambers Property shall pay his/her pro -rata share of
the normal and customary and reasonable costs of the
repair, maintenance, replacement and operation of the
Fire Protection Facilities, so long as the Owners of
the Pierce/Brown Property have not yet obtained the
right to use and enjoy the Fire Protection Facilities
(as described in Paragraph 8, above); and
b. When, and if, the Owners of the
Pierce/Brown Property have obtained the right to use
and enjoy the Fire Protection Facilities (as described
in Paragraph 8, above), then, upon demand, each owner
of a Lot within Chambers Property, plus each Owner of a
Lot within Pierce/Brown Property shall pay his/her pro -
rata share of the normal and customary and reasonable
costs of the repair, maintenance, replacement and
operation of the Fire Protection Facilities.
B. For the purposes of this Easement Agreement,
the term pro -rata share shall be based upon the total
number of (legally established) Lots which benefit from
this Easement Agreement, as described in Civil Code
Section 845, and subject to the rights of apportionment
in the event that any of the parcels of land is
partitioned, as described in Civil Code Section 807. .
Co it is currently estimated that the annual
cost of maintaining the Fire Protection Facilities
(including electrical power and weed control) will be
the sum of Four Hundred Fifty Dollars ($450.00) per
year; and
D. When, and if, a County Service Area has been
established for maintaining and operating the Fire,
Protection Facilities within Chambers Property (as
described in Paragraphs 18 and 19, below), then:
a. Said County Service Area shall have the
right to levy and collect service charges from the
Owners of Chambers Property for the purpose of
repairing, maintaining, replacing and operating the
Fire Protection Facilities. Said County Service Area

shall assume responsibility for the maintenance and
operation of the Fire Protection Facilities; thereafter
the Owners of Chambers Property shall no longer have
the right, or the duty, to maintain or operate the Fire
Protection Facilities;
b. At the time that the Pierce/Brown
Property becomes entitled to use and enjoy the Fire
Protection Facilities, a County Service Area(s) shall
have been established pursuant to Paragraph 8, above,
for the purpose of operating, and maintaining the
combined Fire Protection Facilities. Said County
Service Area(s) shall have the right to levy and
collect service charges from the Owners of Pierce/Brown
Property for the purpose of repairing, maintaining,
replacing and operating the combined Fire Protection
Facilities. Said County Service Area(s) shall have
responsibility for the maintenance and operation of the
combined Fire Protection Facilities; thereafter, the
Owners of Pierce/Brown Property shall no longer have
the right, or the duty, to maintain or operate the
combined Fire Protection Facilities."
3. Section 11 of the Fire Protection CC&R's provides, in
relevant part, the following:
"1�1. MAJOR REPAIRS OR REPLACEMENTS:
As described above, the Beneficial Owners shall,
at all times, maintain the Fire Protection Facilities
in a good operating condition, and shall the pay the
electrical utilities bills, when due. For elective,
non -emergency repairs:
A. The decision to obtain elective major
repairs, the written agreement of the Beneficial Owners
of amajority of the lots to the effect that specified
repair or maintenance work is necessary, shall be
conclusive on the remaining Beneficial Owners.
Pursuant to said majority written agreement, the
agreeing owners shall obtain three bids from licensed
contractors and shall accept the lowest of said three
bids and shall then initiate the necessary repair or
maintenance work;

or her pro rata share of the cost thereof, regardless
of whether such owner shall have concurred in said
majority agreement or not; and
C. As described above, when, and if, a County
Service Area has been established to provide for the
maintenance.and operation of the Fire Protection
Facilities, then the Beneficial Owners shall no longer
have the right, or the duty to maintain or operate the
Fire Protection Facilities."
4. Section 12 of the Fire Protection CC&R's provides, in
relevant part, the following:
"12. COLLECTION ACTION:
If any Beneficial Owner shall fail or refuse to
pay his or her pro rata share of the cost of
maintenance and repair work or damages hereunder within
30 days of a bill for the same being mailed to him or
her, any other Owner shall be entitled, without further
notice, to institute legal action for the collection of
funds advanced on behalf of such defaulting owner for
the necessary maintenance and repair work in accordance
with the provisions of law, including, but not limited
to, California Civil Code Section 845. The prevailing
party in such action shall be entitled to recover, in
addition to the funds advanced, interest thereon at the
current prime rate of interest, until paid, all costs
and disbursements of such -action, including such sum or
sums as the court may fix, and for reasonable
attorneys' fees."
5. Section 13 of the Fire Protection CC&R's provides, in
relevant part, the following:
"13_ MAINTENANCE AND REPAIR ACCOUNT:
The Owners of a majority of the Benefitted Lots
may authorize the creation of a maintenance and repair
account in a savings and loan association or bank.
Monies deposited therein shall be expended only for
maintenance and repair of the above -referenced works,
and the number of signatures required to withdraw
monies shall be specified at the time said account is
authorized."

6. Section 20 of the Fire Protection CC&R's provides, in
relevant part, the following:
1120. NO PROTEST:
Each and every Owner of Chambers Property, plus
each and every Owner of Pierce/Brown Property agrees
that when one or more application(s) is made to Butte
County Local Agency Formation Commission to form a
County Service Area to operate and maintain the Fire
Protection Facilities (and levy and collect service
charges), or to annex to such a County Service Area to
operate and maintain the Fire Protection Facilities:
A. No such Owner shall oppose or protest (either
pursuant to the provisions of the State law or in any
other manner), said formation of the County Service
Area, or annexation thereto, or any of the proceedings
attendant therewith;
Be Each Owner further agrees to any conditions
to be placed on the property at the time of said
formation of the County Service Area, or annexation
thereto, including the right of said public agency to
impose, and levy and collect service charges for the
repair, maintenance, replacement and operation of the
Fire Protection Facilities described herein; and
C. Each Owner further agrees that he will
execute such additional documents as may be reasonably
required by such public agency during the formation of
and/or annexation to said County Service Area."
7. Section 22 of the Fire Protection CC&R's provides, in
relevant part, the following:
"22._ ATTORNEYS" FEES AND COSTS OF SUIT:
In the event any party (including County of Butte
and/or California Department of Forestry, which are
named as third party beneficiaries) to this Easement
Agreement (or his/her heirs, assigns or successors in
interest) files a civil action to enforce any portion
of this Easement Agreement, then the prevailing party
shall be entitled to recover reasonable attorney's fees
and costs of suit."

STATUS OF PAYING THE COSTS OF OPERATING, REPAIRING, MAINTAINING
THE FIRE PROTECTION FACILITIES, PLUS ESTABLISHING AN IMPOUND
ACCOUNT FOR THE REPLACEMENT RESERVES FOR THE FIRE PROTECTION
FACILITIES
As described above, Beverly Chambers, Lowell Pierce and Deborah
Pierce have been paying the costs of operating, repairing,
maintaining the fire protection facilities for the Chambers
Subdivision and the Pierce Subdivision, using their personal
funds.
Beverly Chambers, Lowell Pierce and Deborah Pierce have not
established an impound account for the replacement reserves for
the fire protection facilities.
The Fire Protection CC&R's, described above, require that the
subdivision owners must do the following:
1. Pay the costs of operating, repairing and maintaining
the fire protection facilities for the Chambers Subdivision and
the Pierce Subdivision, pending the formation of a County Service
Area to pay said costs.
2. Cooperate in the formation of a -County Service Area in
which County of Butte would establish the assessments for the
fire protection facilities, and would collect those assessments
from the individual property owners.
In 1997, Beverly Chambers, Lowell Pierce and Deborah Pierce
initiated an Application for the Formation of a County Service
Area for the Chambers Subdivision and the Pierce Subdivision.
However, during the time that Application To Form The CSA was
pending, California Initiative Proposition 218 became law.
Proposition 218 allows the individual property owners within a
County Service Area to protest, and prevent, any increases in the
annual assessments within the County Service Area. Locally, at
least some property.owners within County Service Areas were, in
fact, protesting, and preventing, the (allegedly) necessary
increases in the annual assessments within their County Service
Areas.
During the time that the Application To Form The CSA was pending,
County of Butte could not make up its mind as to whether it
really wanted us to proceed with the formation of a CSA (which

would be subject to the assessment collection limitations of
Proposition 218.) or whether County of Butte wanted us to simply
proceed with a homeowners association which collected assessments
for the operation, repair, maintenance, and replacement of the
fire protection facilities, etc. Stuart Edell and Butte County
Public Works eventually indicated that Butte County Public Works
would not enforce the requirement of establishing a County
Service Area, so long as the property owners were maintaining the
required facilities. Beverly Chambers, Lowell Pierce and Deborah
Pierce allowed the Application To Form The CSA to lapse.
In the event that County of Butte decides to enforce the
requirement of forming a County Service Area to pay for the
the costs of operating, repairing, maintaining and replacing the
fire protection facilities for the Chambers Subdivision and the
Pierce Subdivision, then:
1. When County of Butte establishes the annual assessment
impounds as part of a CSA, those annual assessment impounds tend
to be quite "conservative" (expensive) to ensure that the CSA
will not cost County of Butte any expenditures of its own money.
2. When County of Butte establishes the annual assessment
impounds as part of a CSA, County of Butte includes several
thousand dollars of "administrative over -sight expense" for
the various departments within County of Butte (Butte County
Public Works, Butte County Fire Department, Butte County General
Service, Butte County Auditor, etc.).
The proposed budget includes a line item for the "administrative
over -sight expenses" for Butte County Public Works, Butte County
Fire Department, Butte County General Service, and Butte County
Auditor. These line items would not be actually operative unless
and until a County Service Area was actually formed.
CONDITIONS OF APPROVAL FOR CHAMBERS SUBDIVISION
Paragraph 12 of the "Conditions of Approval for Chambers
Subdivision", as approved by County of Butte on September 1,
1992, required that the Chambers Subdivision "shall meet the
requirements of the Butte County Fire Department". In this
regard:
1. The Chambers family initially met those requirements by
the joint construction of the fire protection well and the
recordation of the "Mutual Grant of Easements for Fire Protection

Facilities and Maintenance Agreement and Offer of Dedication".
2. If the Butte County Fire Department chose to take the
position that this current arrangement does not meet the
requirements of the Butte County Fire Department, then it could
force the formation of a County Service Area.
3. In contrast to the "Conditions of Approval for Pierce
Subdivision", the Chambers family was not required to create an
impound fund for the repair, maintenance and replacement of the
landscape facilities, or of the drainage facilities.
4. It is my prediction that when, and if, this matter goes
to LAFCo for a revised application to form a CSA, Butte County
Public Works will figure out a way to require that the drainage
facilities. (and maybe the landscape facilities) within Chambers
Subdivision must be included in the CSA.
CONDITIONS OF APPROVAL FOR PIERCE SUBDIVISION
Paragraph 34 of the "Conditions of Approval for Pierce
Subdivision", as approved by County of Butte on November 28,
1994, required that the Pierce Subdivision shall "Form a County
Service Area for the maintenance of the fire facilities, drainage
facilities, and landscape maintenance." In this regard:
1. The Pierce family has initially met those requirements
by the joint construction of the fire protection well and the
recordation of the "Mutual Grant of Easements for Fire Protection
Facilities and Maintenance Agreement and Offer of Dedication".
2. If County of Butte wanted to go to war on the grounds
that a CSA has not actually been formed, then it could
force the formation of a County Service Area.
ROAD MAINTENANCE AGREEMENT
I have enclosed a copy of the "Road Maintenance Agreement",
recorded May 3, 1994, which is an encumbrance upon the Chambers
Subdivision, only. In this regard:
1. This is the standard road maintenance agreement which
County of Butte imposes upon all subdivisions; the agreement
requires that all persons using a road must pay the pro -rata
share of the repair and maintenance expenses, but is otherwise
quite vague.

2. The term "road maintenance" is broad enough to include
"road drainage". The repair and maintenance of long term road
drainage facilities (at no cost to County of Butte) is an
important issue with the Butte County Public Works, and with the
Board of Supervisors.
LANDSCAPE EASEMENT AND MAINTENANCE AGREEMENT
As described above, I have enclosed a copy of the "Landscape
Easement and Maintenance Agreement", dated September 21, 1995,
recorded on October 9, 1995, which is an encumbrance upon the
Chambers Subdivision only. In this regard:
1. County of Butte has required that the Pierce
Subdivision must include a "landscape maintenance" component in
its maintenance organization, but has not imposed this
requirement upon the Chambers Subdivision,
2. It would be theoretically appropriate for the
property owners within Chambers Subdivision to join forces with
the property owners of Pierce Subdivision to jointly provide
landscape maintenance adjacent to Speedway Avenue.
3, Within Chambers Subdivision, the water for the
landscape maintenance is provided from the domestic water wells
located on Lot One and on Lot Nine, with reimbursement from the
other property owners in Chambers Subdivision.
ADMINISTRATIVE OVERHEAD COSTS IN THE EVENT THAT THESE PROJECTS
ARE FORCED INTO A COUNTY SERVICE AREA
Please note the budgetary materials which I have obtained from
County of Butte concerning the fire protection well which is
located within CSA 90 (which is near Longfellow Lumber Company,
near Southgate Subdivision). As you can see, County of Butte is
collecting $7,230.00 per year to maintain the CSA 90 fire
protection well; As you can see, the majority of this is
represented by interfund transfers to "Public Works" etc.
"That's the price you pay when its in a CSA".

The fire hydrant at 21 Ranchwood has a static psi of 30 and flow of 0. The hydrant at 24 Foster Place has a static
psi. of 35 and a flow psi of 0. The fire hydrant at
18 Laguna has a bag over the hydrant and has been placed out of service. These problems were noted during the
annual services testing and maintenance that was done this year.

pump maintenance for CSA 179 presents a problem. This CSA was recently formed from an
existing subdivision so that there was no initial funding provided - there will be funding
available beginning 7/03 as that is when the assessments will be levied on the 12/03 and
4/04 property tax statements. As such, the invoice # 0070599 -IN for $100.00 from Durham
Pump's 4/7/03 pump system service performed cannot be paid at this time

Section 1. Environmental Findings:
A The Commission finds that the formation of the County Service Area for the
operation and maintenance of existing storm drain facilities, fire protection
facilities and street lighting is consistent with the approved County subdivision
plans and associated environmental documents and is considered Categorically
Exempt from the California Environmental Quality Act (CEQA) pursuant to
Section 15301, Existing Facilities, which exempts the operation, maintenance
and repair of existing public or private facilities involving negligible or no
expansion of use beyond that what is exists.

A. The Commission has considered the factors determined'
by the Commission to
be relevant to this proposal, includingbut not limited to
,Sphere of Influence
and General Plan consistency, and other factors specified in

Section 56841 and as described in the staff report dated August ugust 19, 2002 for
the meeting of September 5, 2002.
B. The Commission recognizes that the conversion of •
agricultural land for this
proposal has been considered by the Countyof Butte General
Plan Land Use
Element, the subsequent approval of the residential
(SR -1 ) zoning and the
subsequent approved subdivision of the parcel. The •

consistent with the approved development plans and conforms to
the County
of Butte General Plan.
C. The formation of County Service Area No. 179 is for the operation and
maintenance of storm drainage facilities, fire protection facilities

lighting services for the 17 lot residential subdivisions.
D. The subject territory includes approximately 17 '

identified as APN's 040-640-001 through 009 and 040-040-075 075 through 082
and is assigned the following distinctive short term designation:
