Environmental Findings: A. The Commission certifies that it has reviewed and considered the Mitigated Negative Declaration and Addendum to the M igated Negative Declaration prepared ana adopted by the County of Butte on June 24 and August 16, 2005, for the residential subdivision and proposed district for__ .on to include the fixing of a sphere of influence, which does not identify any significant impacts associated with the project that were not mitigated. The Commission finds no compelling grounds to require supplementing the environmental documents prepared by the County of Butte. Section 2. Determinations: A. The proposed county service area is formed pursuant to the County Service Area Law (Chapter 2.2, Part 2, Division 2, Title 3 ofthe Government Code, commencing with Section RESOLUTION NO* 15 2405106 25210.1) and has been initiated by Board of Supervisors Resolution No. 004-184 adopted October 12, 2004. B. Pursuant to Government Code Section 56100, the Commission proceedings are conducted pursuant to the principal act with the C ' sion serving as the conducting authority. C. The proposed district is only empowered to provide for the operation and maintenance of storm drain 'ties, fire protection ' 'ties and street Lighting services, required by the County as conditions ofapproval for the 7 lot residential subdivision on approxunmately 7.59 acres. Any expansion of powers oilier than approved herein will require the approval of the Commission. D. The subject temEtory includes approximately 7.59 acres of private property identified as APN 047-460-005 and is assigned the following distinctive short term designat--05-08. Formation of County Service Area No. 180 (Redhawk Ranch Subdivision). E. Pursuant to Proposition 218, the Board of Supervisors has reviewed and approved the engineer's report and proposed budget for the provision of necessary services and adopted said charges by Resolution No. 04-268. F. As this formation has been initiated by the Board of Supervisors Resolution No. 04-184 and has been supported by the affected landowners through the Ballot Proceeding identified in Board of Supervisors Resolution No. 04-268, pursuant to Government Code Section 56100, the Commission approves the fonras the conducting authority without fiuther action required of the County. G. The district proposal is consistent with the Commission policies found in Section 5.2 of the Policies and Procedures in flax: 1. The proposed land uses to be served by the district have been determined by the Commission to be consistent with the County General Plan Land Use Element and the North Chico Specific Plan and that no other affected agency with land use authority have objected to the proposal. 2. No existing agency in the area can more efficiently provide the desired services. 3. The proposal included a Plan for Services to be provided 4. The proposal will benefit the public by providing necessary urban services to new development. 5. Conditions adopted by LAFCO: A All Butte County and State of California fees must be paid in full prior to filing the Certificate of Completion. B. The map and legal description shall comply with the Department of Public Works and State Board of Equation requirements. C. The legal description and map, if rejected by the State Board of Equalization or amended by action of the Commission, will be revised at the expense of the applicant, prior to filing the Certificate of Completion. Municipal Service Review Findings Section 1. Environmental Findings: A. The adoption of the Municipal Service Review does not require environmental review pursuant to the California Environmental Quality Act, however, the C*sion certifies that it has reviewed and considered the Mitigated Negative Declaration and Addendum to the Mitigated Negative Declaration prepared and adopted by the County of Butte on June 24 and August 16, 2005, for the residential subdivision and proposed district formation to include the Bing of a sphere of influence, which does not identify any significant impacts associated with the project that were not mitigated The Commission finds no compelling grounds to require supplementing the environmental documents prepared by the County of Butte. Sections 2. Determinations: A. The Commission has considered the data, recommendations, and determinations 180-1 through 180-9 and contained in the Municipal Service Review attached to this staff report and identified as LMCO Exhibit "1" and finds that: 1. The determinations accurately represent the characteristics of the district, the intended servicers to be provided and the level of the services to be provided; and 2. The determinations demonstrate ti�at described services will be adequately provided as described in the proposed budgets. Sphere of Influence Plan ,I+"ndinews Section I. Environmental Findings: A. B. The Sphere of Influence Plan attached to this staffreport as LAFCO Exhibit "2," accurately reflects the judgement of the Commission with respect to the: 1. Planned land uses within the district; and 2. Agricultural and open space land considerations; and 3. The need for and availability of services; and 4. The planned capacity adequacy of proposed facilities; and 5.- Any social or economic communities of interest. C. The Sphere of Influence shall be coterminous with the boundary of the county service area. F' 2006106 and Future Fears {Exhibit "Cl. District Characteristics CSA No. 180 (Redhawk Ranch Subdivision) is an area of unincorporated territory located in the north Chico area within the boundaries of the North Chico Specific Plan; and provides the financing.for the. provision of street ligh.ng, storm drainage and fire protection services. The CSA area is to be developed with single family residential uses at suburban. densities and wiq serve seven. (7) parcels. The'District's Sphere of Influence -is to be coterminous vvi#h its service area boundary. The- formatio of the county servile area was initiated by the Board of Supervisors Resolution No. 04-1$4 in 2004. Infrastructure Needs and Deficiencies Tbhe County Department of Public works reports that: Three (3) individual street 11' is are intended to serve the residenfial subdivision. The .street lights v�itl consist of tight f lures affDced to steel poles at various points throughout the - neighborhood. • The drainage facilities consist, of street side drains 'and a detention -basin designed- in.. accordance with accepted County engineering standards. • The fire protection system consists of a single well, water pump and hydrant located on lot 2 of the subdivision. The area will be fully developed with minimal opportunities for redevelopment 'in the future due to sewer -service constraints, Detefmination CSA 184-1. The CSA as deknbed appears to provide an adequate level of street lighting,, storm drainage and rite protection services. Growth and Population The north Chico area is anticipated to grow at modest levels due to land use constraints primarily related to parcel size restrictions of one acre or larger at densities consistent with current land use Bate LAFCO 0 Municipal SeMce review * County Service Area No. 180 2 designations.The subdivision is expected to be fully developed with an estimated population of approximately 15 persons. Determination CSAR 180-2: A significant increase in populaf►on is not anticipated within this County Service area. Planned faciffies as discussed above should be adequate to serve the project area throughout -the five year! planning- period. : Financing Constraints and Opportunities This CSA vin71 be a post Proposition 13 district that is funded by individual parcel assessments subject to voter approval pursuant to Proposition 218 requirements. Pursuant to Board of Supervisors Resolution -No. X44-268., a.-maxi*munt parcel :chane ;of $50.1.72 was. e,statblished December. 14r4K The currentper parcel charge being collected for the single -undeveloped parcel in the 2005/06 Budget is $3,512 and is a deposit to be paid by the developer based on the approved 7 lot subdivision. Subsequent years budgets vwIl be based on a. maximum parcel assessment of $512.7Zw.hich would. generate $3,512 per year as. described in the approved budgets attached as Exhibit "O". The current annual parcel assessments for this CSA appear adequate to provide- the intended services based on current. County administrative/maintenance costs and Pacific Gas and 'Electric charges remaining fairly. consistent over the planning period. Deterrnination CSA 180-3: The current parcel assessment is adequate to provide intended services _based on current County adrninistrafive/maintenance costs and existing rates charged by PG&E. .Deten nina#ion CSA 180-4: if th6re is a significant increase in PG&E mates or a desire to expand the .intended services, a Proposifion 218 election will be required in order to set a new tax rate. Cost Avoidance Op. ortunities Since the County -approved residential subdivision is required to provide the* intended services, the. CSA is the only reasonably available funding mechanism for the provision of the necessary urban improvements at this time. The anly way to avoid the costs of the CSA Would be to r6move* the requirements for the intended infrastructure or allover the parcell to remain undeveloped. Determination CSA 180-5: There am no realistic costavoidance opportunities available if the property is to be developed in accordance with County plans. . Opportunities for Rate Restructuring. There are no reasonable opportunities for rate restructuring since the County administrative and maintenance costs are fixed and PG&E charges are regulated by the Public Utilities Commission. Determination CSA 180-8: Thea aro no opportunities for rate restructuring. Butte LAFCO • Municipal Service Review -0 County Service Area No. 180 3 porfunifies for Shared Facilities 1 Government Structure options There are limited existing overiapping jurisdictional services affecting the proposed CSA area that would allow for shared operation and maintenance of the intended facilities. The proposed CSA area is within CSA No. 87 (Keefer Road and Rock Creek Drainage District) which is empowered to install basicflood-control�irnprovernents;-collectJdeveloper fees for additional -capital improvements- acquire right-of-ways, and -maintain all drainage & flood control improvements and natural drainage courses. Currently CSA 87 reportedly provides storfn drain maintenance and food control services. `there are thirteen additional individual CSA's providing similar services to residential development in the north Chico ' area. A map of the north Chico area CSA's is attached as Exhibit "D" to the report. There is a logical opportunity for urban services. to be provided on a regional scale under a consolidated CSA or other regional service providing mechanism such as a community services district or Mello -Roos district. These options are not considered feasible by the County due to the manner in which parcel charges and CSA budgets are administered on a project by project basis, thus creating difficulty in evaluating service costs between subdivisions with potentially different levels of service and number of contnibuting parcels. A consolidation. of CSA services would require a tremendous analysis effort and would most likely result in multiple zones of benefit that would require a similar amount. of administration as the current multiple individual CSA approach. The County response to this question is contained' in their letter of August 10, 2005 which is attached as Exhibit ".E" to this report.. - 'To a. large degree, the opportunity for a regional approach to the delivery of urban services in the north Chico area has passed as, individual- subdivisions were approved with each project being designed independently of . the whole, thus severely smiting the opportunities for a unified plan for - services. There does remain the future option for an expanded City of Chico Sphere of Influence and eventual annexation. However, this option would require significant planning and administrative functions making it an unrealistic option for the immediate development of the area. Determination CSA 180- 7: Limited viable opportunities exist for shared facilities as .the opportunity for a regional approach to the defivery of urban services in the north Chico area has passed as individual subdivisions were approved with each project being designed independently of the whole, thus severely limiting the opportunities thr a unified plan for services. Management Efficiencies The operation and maintenance of this County Service Area involves several layers of County government to administer while. providing the identified services. The Butte County Board of Supervisors is the governing board of the County Service Area; however, the County Administrative Office is not the primary point of public -contact. Management responsibility is primarily distributed to the Butte County Department of Pubric Forks (BCPWD) which provides staff to develop the annual budget, maintains administrative oversights responds to public inquiries, coordinates -with PG&E for the payment of street fighting services and maintains the drainage infrastructure. Fire infrastructure is the responsibilfty of the Butte County Fire Department. Fiscal accountability is provided by the Butte County Auditor's Office which prepares the annual Local Government Financing Act (LGFA) reports required by the State. Additionally, the State Board of Equalization establishes the Tax Rate -Area for Butte LAFCO 0 Municipal Service Review 0 County Service Area No. 180* 4 the purposes of collecting taxes and finally,. the Local Agency Formation Commission is responsible for maintaining boundary maps and service evaluations. Determination CSA 180-8: Outside of provOing common serwoes-on a regional scale, there are limited opportunities for increasing management efficiencies due to the various functions necessary to operate a countyserlce area.' LocalAccountability and Governance As. discussed in the Management Efficiencies section above, there are several levels of County governance that exist along with the State regulated utility :provider, PG&E. Structurally, the County is the service provider, but all point of service deUvery issues such as broken lights or damaged tight poles are assumed by PG&E. In this regard, the public has no single point -of governmental contact to seek remedial action. Inquiries from the public would be routed to the various management entities depending on the issues involved, which can often cause frustration to the public. The budget for this p 9 CSA is included in the greater Butte County budget and would be difficult for the general public to access and understand. . Determination CSA 180-9: There is minimal, but adequate accountability and local governance through the public hearing process. However, a single point of public contact should be assigned by the County Administrative Ofce with the authority to resolve public inquiries as they arise. Summ ry Statement County Service Area No. 180 is intended to provide -the identified services within its approved budget and is the preferred option of the County forthe provision of individual project services. However., the CSA as a method of providing common urban services should- be considered- on a regional scare rather than on an individual project basis in order efficiencies to increase management eciencies and reduce the number of governmental entities serving a defined region. Final Statement of Determinations The Butte Local Agency Formation Commission has made the. following Determinations for CSA No. 180. These Determinations are the basis for adopting or amending the CSA's Sphere of Influence and possible reorganization options. it is understood that the changes in land uses and government funding structures may require these Determinations. to be reviewed' periodically and- .possibly amended to reflect changes in form or function. Determination CSA 180-1: The CSA as descnbed appears to provide an adequate level of street lighting, storm dMinage and fire protection services. Determination CSA 180-2: A significant increase in population is not anticipated within this County Service Area. Planned facilities as discussed above should be adequate to serve the project area throughout the five year planning period. Separate CSAs generate their own TRA (a one shot project for the State Board of Equalization), which remains constant, parcel changes within. the TRA are easy yto fnd and all the parcels within. the TRA are charged the same amount. The Commission has considered the factors determined by the Commission to be relevant to this proposal, including, but not limited to, Government Code Sections 56425, 56427 and 56428 and as described in the staff report dated September 21, 2005 for the meeting of October 6, 2005 in that: Planned Land Uses 1. The unincorporated territory in question is located approximately one mile north of the City of Chico in an area regulated by the North Chico Specific Plan.
