HomeMy WebLinkAbout19-290A i A WHEREAS, the North Chico area of Butte County has experienced flooding in the past as discussed in the Butte County General Plan Health and Safety Element at page 11-9, as well as the flooding that occurred in early 2019; and WHEREAS, the Butte County General Plan specifically mentions flooding in Rock Creek and Keefer Slough that has inundated "State Routes 99 and 32 and several county roadways, as well as impacting extensive residential and agricultural areas;" and WHEREAS, Butte County General Plan Goal HS -2 states "Protect people and property from flood risk;" and WHEREAS, it is known that many areas not currently listed in the FEMA Floodplain maps receive floodwater in less than 100 -year events; and WHEREAS, the California Department of Water Resources is currently working to update the FEMA mapping, and it is likely that new areas will be added to the 100 -year base mapping; and WHEREAS, the Butte County Board of Supervisors wishes to insure that applicants for development and building permits in the North Chico area are made aware of prior flooding that has occurred on or near the parcel on which the permit is being sought; and WHEREAS, the Butte County Board of Supervisors wishes to make use of the County's permitting system to identify those parcels that should receive the warning and that should acknowledge having received the warning. NOW, THEREFORE, BE IT RESOLVED, that the Butte County Board of Supervisors hereby finds and declares the following: Applicants for development and building permits in the North Chico area (as defined in Exhibit A, attached) should be informed of prior flooding that has occurred on or near their parcels. The Floodplain Administrator is authorized to place an appropriate warning regarding area flooding, in the County's permitting system, on all parcels on or near where the flooding occurred. Staff is authorized to inform applicants for development permits when such a warning has been placed on their parcels, and to require the property owner to sign an acknowledgement (Exhibit B) that the property owner is aware of the warning. 4. It contains a Health and Safety Element that provides information about risks in Butte County due to natural and human -made hazards. One of the risks is flooding. The Health and Safety Element has identified Mud Creek and Sycamore Creek as principal areas subject to flooding. It also states: "flooding in Rock Creek and Keefer Slough located north of Chico, occurred on several occasions in the 1980s, 1990s and 2000s, inundating State Routes 99 and 32 and several county roadways, as well as impacting extensive residential and agricultural areas in and around the North Chico area and the unincorporated community of Nord." This is an advisory warning that your property, which is located in the North Chico area, may have had water on the surface of the property or have been in proximity to land that had surface water as a result of rain events, flood events or near -flood events. Residents and property owners have expressed their concern regarding previously observed surface water of varying depths during rain events, flood events or near -flood events in the area. Your property may or may not be located in a Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM) 100 -year floodplain. You are advised that you should consider the potential for flooding when making plans to develop your property and that you can seek information from sources including, but not limited to, the following: the Butte County Department of Development Services; the Butte County Department of Public Works; FEMA's National Flood Insurance Program; the Department of Water Resources' Central Valley Flood Protection Plan; neighbors, property owners, real estate professionals, and others on their observations; and archive information from news media.
