HomeMy WebLinkAbout19-291Resolution No. 19-291 RESOLUTION ADOPTING AMENDMENTS TOTHE GENERAL PLAN HEALTH' AND SAFETY ELEMENT KHAN|0G THE LOCAL HAZARD MITIGATION PLAN APART OFTHE ELEMENT WHEREAS, Butte County recognizes the threat that natonaU hazards pose to people and property within our community; and WHEREAS, undertaking hazaird mitigation actions, will reduce the potentia!l for harm to people and property from future hazard occurrences; and WHEREAS, the U.S, Congress passed the Disaster Mitigation Act of 2000 ("Disaster Mitigation Act")emphasizing the need for pre -disaster mitigation ofpotential hazards; and VV������tbeDisa�terMitigation �ctmade�vai|ab|ehazardmn�' tiVngrants tostate and local governnment� and WHEREAS, an adopted Local Hazard Mitigation Plan (LHK4P) is required as a condition of future funding for mitigation projects under multiple FEMA pre'aind post -disaster mitigation grant programs; and WHEREAS, Butte County desires to comply with the requirements of the Disaster Mitigation Act aindto, augment its emergency planning efforts bvformally adopting the Butte County LHMPbymaking the LHMPpart nfthe Health and Safety Element of the General Plan in accordance with the requirements of AB 2140; and WHEREAS, adoption by the Butte County Board of Supervisors demonstrates the jurisdiction's commitment to fulfilling the mitigation goals and objectives outlined in this Local' Hazard Mitigation Plan; and WHEREAS, the Board of Supervisors held e duly noticed public hearing on November 5, 2029 concerning the proposed General Plan Amendment 10the Health and Safety Element. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors hereby makes the following findings with respect tnthe proposed (Semeral|Plan Amendment: A. The proposed General Plan Amendment is in the public interest. B. The proposed General Plan Amendment is consistent and compatible with the rest of the General Plan. [ The potential effects of the proposed General Plan Amendment have been evaluated and have been determined not to be detrimental tothe public health, safety, or welfare. D. The proposed General Plan Amendment has been processed in accordance with the applicable provisions of the California Government Code and the California Environmental Quality Act (CEQA). The General Plan Amendment is determined to be ex�mpt pursuant to State CEQA Guidelines Section 15061 (b) (3) (Common, Sense Exemption). ANotice ofExemption shall befiled inaccordance with CE[A. E. The General Plan Amendment fulfills Assembly Bill (AB) 2140, Hancock, and therefore makes Butte County fully eligible for disaster relief funding under the California Disaster Assistance Act NOW, THEREFORE, BE IT FURTHER RESOLVED that Butte County adopts the General Plan Amendment in accordance with the requirements of AB 2140, as shown under the attached Exhibit A. vote PASSED AND ADOPTED by the Butte County Board of Supervisors this 51' day of November, 2019, by the following AYES: Supervisors Connelly, Lucero, Ritter, Teeter, and Chair Lambert NOES: ABSENT: NOT VOTING: Val Steve Lamb 6r Butte Coup Y80C rd of Supervisors ATTEST: Shari McCracken, Chief Administrative Officer and Clerk of the Board of Supervisors By: — De putyG
