53 - "Camp Fire Recovery" Amending Section 53-67 "Rebuilding Warning" and Adding Section
53-68 "Reconstruction of Single -Family Dwellings Damaged or Destroyed by the Camp Fire in the
Butte Creek Canyon" - Pursuant to California Government Code sections 25123(d) and 25131,
County Administration recommends adoption of an urgency ordinance amending Section 53-67
"Rebuilding Warning" and adding Section 53-68 "Reconstruction of single-family dwellings
damaged or destroyed by the Camp Fire in the Butte Creek Canyon (-BCC) Overlay Zone and the
Watershed Protection (-WP) Overlay Zone." The ordinance amends the rebuilding warning
provided to building permit applicants inside the Camp Fire area in Section 53-67, and adds
Section 53-58 to allow site preparation work and the installation of a foundation for
reconstruction of a single-family dwelling damaged or destroyed in the Camp Fire between
November 15 and April 1. At a previous Board of Supervisors meeting, staff indicated that the
County could provide building permit applicants inside the Camp Fire area with a warning related
to hazard trees on their property. As amended, Section 53-57 adds language specific to the
danger of standing fire -damaged and hazard trees on such properties into the warning applicants
currently receive. The addition of Section 53-68 would allow the timely reconstruction of single-
family dwellings damaged or destroyed by the Camp Fire in the -BCC and -WP Overlay Zones.
Currently, Butte County Code sections 24-34.1(D)(8)(e)(a) and 24-46(H)(3) specify that soil
disturbance shall not be conducted during the rainy season (November 15 through April 1) in the
—BCC and —WP Overlay Zones. As added, Section 53-58 allows the Director of Development
Services and the Director of Public Works to authorize the holder of a building permit for
reconstruction of a single-family dwelling to perform site preparation work and install a
foundation for the single-family dwelling between November 15 and April 1, when weather
forecast shows less than a 20% chance of rain during the next ten days and erosion control
measures have been put into place. The urgency ordinance would take effect immediately —
action requested — 1) WAIVE THE FIRST READING OF THE ORDINANCE ENTITLED, AN URGENCY
ORDINANCE OF THE COUNTY OF BUTTE AMENDING SECTION 53-67 AND ADDING SECTION 53-
68 TO CHAPTER 53, ENTITLED "CAMP FIRE RECOVERY," OF THE BUTTE COUNTY CODE"; AND 2)
ADOPT ORDINANCE AND AUTHORIZE THE CHAIR TO SIGN (4/5 VOTE REQUIRED). (Development
