Thank you Robin for the question.
My understanding is that the Administrative Permit is being held by the outstanding encroachment
violation.
After some deliberation with staff and the Director, there is little leeway we are able to provide
regarding the requirements provided in previous correspondence. We recognize the limitations
regarding weather as stipulated below, but the requirements previously stated still need to be met.
We also have discretion at the department level on the type of material to be used for the driveway
apron. We have consistently required that asphalt shall be used in snow plow areas as concrete has
a tendency to harm plows. The installation of asphalt does require certain weather conditions. An
alternative solution would be to provide a concrete apron (which has a broader weather window) up
to three to four feet away from the existing pavement edge; this three to four foot area could be
filled with cold-patch material for the winter. Then next summer, the cold patch can be removed
and hot mix asphalt can be installed between the existing pavement roadway and the concrete. We
will require some form of surety (cashier’s check or letter of credit) that this subsequent hot mix
asphalt work will be performed by July 30. If by July 30 this is not installed, we can pursue
implementation of this work using this surety. This encroachment violation has been an outstanding
issue for nearly seven years, and it would be great if this could be resolved.

I am not aware of a Del Oro connection for these activities, it is served by a domestic well that may
need to be evaluated for a public water supply well if the proposed RV Park goes over the threshold
of a small public water system. We will be able to determine that once the below items/information
is submitted to our office for review.

Environmental Health notified Mr. Nikolauson early November that we require the following in order
to move forward with review of the Admin permit application with no response back at this time:
1. A site map must be provided showing the RV locations in relation to the existing septic tanks
and leachfields.
2. The applicant must demonstrate: A. How the RV’s will be plumbed into the existing septic
systems. B. How the existing septic systems are sized large enough to accommodate
wastewater flows from 15 temporary dwellings, in addition to the flows from the residential
dwellings that are already onsite. This will most likely require an Engineers report.
3. The applicant must provide an estimation of how many total people the well will serve on a
daily basis so that the water system can be evaluated if it qualifies as a small community
water system. At a minimum EH will require basic water sampling requirements.

Hello, Radley;
Supervisor Teeter would like to know that if the PW Encroachment Lien at
Loch Lomond Park Foundation property would be cured by the completion
of the required “asphalt apron” connecting property to the paved street?
The weather is a problem for the construction of this, so what leeway isprovided?
Also, is this Encroachment lien providing obstruction to the Administrative
permit moving forward, which was applied for to provide disaster housingfor the temporary RV camp?
He states he is being required to provide underground pipes, rather than
using his portable waste containers, for emptying RV waste which is beingwheeled over to the RV Dump Station tank for disposal. He stated that he
has been given 30-days to cure this problem, which may not be possible
given the weather issues and financial burden.
We understand that there are barriers to completion, the property owner is
attempting to cure his financial burdens of current and past permitting
problems and fines. Currently he is working to obtain a NVCF grant to
assist him in meeting all requirements. Grant funds may help cure thewaste issue by allowing the Park’s bathrooms to be completed. If the
permit for the bathrooms and building is completed, will this cure the
sanitary issue? Housing for the current residents is at stake.
Please outline what steps come first, to assist him in his quest to rectify
and become legitimate. Please feel free to contact Mr. Nikolauson and
keep Supervisor Teeter updated with your outcomes or progress in these
issues concerning this property.
