Departments Comments
Planning Land Use, Zoning, & Permitting
• The parcel is zoned Light (GI) and Heavy Industrial (HI)
• The LI and HI zones allows crop cultivation as a permitted use, but only as an interim use on parcels of 1-acre or more in size prior to subdivision and development with industrial uses.
• Agricultural Processing is a permitted use in the HI zone.
• Will need to provide creation deed to Public Works to determine if parcel was created in compliance with Butte
County Code and the Subdivision Map Act (required for any development type permits – building permits/septic systems/domestic well)
• Work with the Agricultural Commissioner’s Office to establish the crop cultivation.
• Contact the Natural Resource Conservation Service for determination on environmental impacts associated with the site preparation for the crop cultivation.
• Parcel is located in CSA-90, Zone 2 (Fire Protection and Drainage)
• Parcel is located in CSA-114 (Chico Urban Area)
• Contact Butte County Air Quality Management District for any possible permits ((530) 332-9400)
• The southern portion is located in Flood Zone AO and a small area along the eastern portion is in Flood Zone A.

• Note in TrakIt identifies the parcel within the Nitrate Compliance Area (cannot process new permits for
development – need confirmation from Butte County Environmental Health)
• Check with Butte County Environmental Health on use of Agricultural Well for fire protection (applicant states fire
protection will be on a tank system)
• Information in County records states the potential for elderberry shrubs (host plants for the federally listed Valley
Elderberry Longhorn Beetle) which may exist on the site. Advise you to contact the California Department of Fish
and Wildlife for potential impact to on-site elderberry shrubs.
• Appear to be avoiding impacting the Cottonwood Willow Riparian Forest area.
• Possible vernal pools in the proposed crop cultivation area.

Building • Any new structure (green houses and processing facility) will require building permits.
• Power will be issued for the green houses.
• Will need a building permit for each structure. Electrical and mechanical will be included with each permit.
• Will need flood elevation certificate (for electrical) for the green houses. (talk with Radley Ott, Public Works at 530.538.7681 or ROtt@buttecounty.net)
• Grading for the structures will addressed with the building permits.
• Addresses will be assigned when building permits are issued. Addresses for green houses can be off of Marybill Ranch Road (will need property owner’s permission to use Marybill Ranch Road).

Public Works • Drainage – No increase in peak storm runoff is allowed with any additional development. You may either retain or
detain and discharge runoff where it currently leaves the property. Provide engineering analysis to the Land
Development Division of the Public Works Department with a minimum of $700.00 plan checking deposit prior to approval of building permits.
• Private road improvements are not required for Southgate Lane as a condition of building permit issuance.

• Submittal of a grading permit is required if the Agricultural Commissioner does not find the project ag exempt and
more than 50 cubic yards of earth movement is proposed for farming activities. The Public Works Department will consider if an exemption is warranted based on county ordinance.
• Application under the State Regional Water Quality Control Board National Pollution Discharge Elimination System (NPDES) is required because the project is located in an MS4 permit area.

Agricultural Commissioner
• Board of Supervisors have provided direction to the Ag Department and CDFA (California Department of Food and Agriculture) to develop land use restrictions/requirements for industrial hem including zoning and
buffer requirements. Need to determine if the baseball use is considered a sensitive receptor that will require a buffer determination from the hemp cultivation. Possible less of a buffer for indoor grow.
• Inside versus outside grow. Inside grow (greenhouses) need to be at least 1 acre.
• Current registrations are for one-year.
• New regulations per SB 153 take effect January 1, 2020.
• Possible regulations could include, but not limited to, buffers, quantity, and location.
• Concerns how hemp cultivation would impact surrounding agricultural uses.
• Require registration for industrial hemp cultivation.
• Grading – CDFA (California Department of Food and Agriculture – Food and Agriculture Code Section (FAC) 81003 requires the agricultural commissioner approval for land use alterations prior to issuing
registration if land is altered only) – Plan for preparing land for grow
• State regulations – comment period on the State Program closes on 12/2/19
• Notice of intent to grow to the City of Chico (parcel is in the City’s Sphere of Influence)
• Cultivation or industrial hemp requires registration with CDFA through the agricultural commissioner prior to
cultivation/
• ~ 5,000 sq. ft. minimum for greenhouse production
• Setbacks for indoor cultivation to be determined. o Possible production of CBD flour. o 50% of outdoor grow setback for greenhouse cultivation has been noted in other county restrictions.
• Grading for future AG may not be exempt per AG Commissioner if requesting grading permit exemption (only if land alterations are being done). o Altering land is specified in FAC involving cultivation of hemp (previous bullet). o Plan is required to be submitted with registration.

• CDFA registration is pending.
• Grading (FAC Section 81003c of Hemp Law – for commercial hemp production) o Required legal description, GPS coordinates and map specifying proposed land changes or alterations. o Chuck - there was past farming history. o Outdoor growing - notice to City of Chico? o Awaiting zoning clearance per Uriah Johnson. o SoI issues for City of Chico

Environmental Health • Please contact Environmental Health directly for their requirements for water (wells), wastewater (septic system
and leachfield) and hazardous materials.

Butte County Fire/Cal Fire • Access roads will need to support fire truck access (40,000 lbs)
• If any gates are used, must comply with gate standards.
• MSDS needed for all substances. Need information on types of hazardous materials and quantities stored.
• Processing facility will need to meet new fire codes effective 1/1/2020.
• Provide list of types of machinery used.
• Storing of Biomass? Inside/Outside. Inside storage could impact occupancy type. How long will it be stored?
Need to know location to determine setbacks.
• Need to meet fire flow requirements.
• Parcel is located CSA 90

Administration/ Economic Development
• Currently the Board of Supervisors do not have any regulations in relation to hemp.
• The Board has directed (at the 10/8/19 meeting) the Agricultural Commissioner’s Office come back with
regulations associated with hemp cultivation/processing (anticipating March 2020.

• How many truck trips will be generated?
• Sources of low interest loans based on job creations/usage.
• Can work with you on Community Development Block Grant (CDBG) when funding for public improvements.
• Statewide community impact fees (SCIP) financing.
