The review and decision-making authority may approve an application for a Variance or Minor Variance only if the proposed project complies with the applicable regulations the Zoning Ordinance requires (Butte County Code, Chapter 24-231 Findings). Please provide an explanation for the following questions to support your request and assist the Zoning Administrator or Planning Commission in making the necessary legal findings to approve the variance. Minor Variance request is for an 8' sideyard set back. Over a dozen other properties within the same subdivision have enjoyed the benefit of constructing accessory structures within substantially less than the current 20' side yard setback, including the immediate adjacent property to the east with an accessory structure just 6' from the property line. Granting Minor Variance will cause no environmental impact. RI  4.The Variance or Minor Variance is necessary for the preservation and enjoyment of substantial property right possessed by other property in the vicinity or in the same zone as the subject property. This benefit has been enjoyed by more than a dozen other properties in the vicinity (same subdivision) in the same zoning, including the neighboring property with a structure built just 6' off the property line. Granting this Minor Variance will not adversely affect the neighborhood. It is consistent with numerous other accessory structures built in the same subdivision. This Minor Variance does not constitute a grant of any special privileges; it is consistent with structures constructed on other parcels within the vicinity and same zoning. Minor Variance request pertains strictly to allowing an 8' sideyard setback. No use or activity prohibited by the Zoning Ordinance is intended or being proposed. The requested Minor Variance complies with all other applicable standards in the Zoning Ordinance, other County ordinances, the General Plan and all other building codes, other than the requested 8' sideyard setback.
