WHEREAS, in compliance with Government Code section 7522.56, the Butte County Board of Supervisors must
provide CalPERS this certification resolution when hiring a retiree before 180 days has passed since his or her retirement
date; and
WHEREAS, in a continued effort to address the COVID-19 state of emergency, the Governor of California has
released Executive Order N-35-20; and
WHEREAS, Leonard Goldkind retired from the Butte County Superior Court on April 10, 2020, having served as a
Court Commissioner; and
WHEREAS, Government Code section 7522.56 requires that post-retirement employment commence no earlier
than 180 days after the retirement date, which is October 6, 2020, without this certification resolutions; and
WHEREAS, Government Code section 7522.56 provides that this exception to the 180 -day wait period shall not
apply if the retiree accepts any retirement -related incentive; and
WHEREAS, the Butte County Board of Supervisors, the County of Butte and Leonard Goldkind, certify that Leonard
Goldkind has not and will not receive a Golden Handshake or any other retirement -related incentive; and,
WHEREAS, the County of Butte hereby appoints, Leonard Goldkind as an, extra, help retired annuitant to perform
specialized duties as Deputy District Attorney for the County of Butte as permitted under Government Code Section 21224
and Executive Order N!-35-20, effective after April 28, 20,20; and
WHEREAS, no matters, issues, terms or conditions related to the this employment and appointment have been or
will be placed on a consent calendar; and
WHEREAS, the employment shall be limited to 960 hours per fiscal year, with the exception of hours worked under
Executive Order N-35-20, which are hours worked between March 4, 2020 and the date the state of emergency is lifted;
and
WHEREAS, the compensation paid to retirees cannon be less than the nor exceed the maximum monthly base
salary paid to other employees performing comparable duties, divided by 173.333 to equal the hourly rate; and
WHEREAS, the maximum bi-weekly base salary for this position is $4,920.00 and the hourly equivalent is $61.50,
and the minimum bi-weekly base salary for this positions is $4,047.00 and the hourly equivalent is $50.59; and
WHEREAS, the hourly rate to be paid to Leonard Goldkind will be $61.50; and
WHEREAS, Leonard Goldkind has not and will not receive any other benefit, incentive, compensation in lieu of
benefit or other form of compensation in addition to this hourly pay rate.
NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors hereby certifies the nature of the
appointment of Leonard Goldkind, as Deputy District Attorney, is essential to continue to provide justice and public safety
by prosecuting felony cases, and backfill the Department's shortage of experienced prosecutors.
