HomeMy WebLinkAbout20-065RR (RURAL RESIDENTIAL) ZONES WHEREAS, on, September 18,I819the Butte County Board ofSupervisors directed staff toinitiate enamendment to the Zoning Ordinance regarding the permitting, through a minor use permit process, of child care centers within the FR (FnmthiU Residential) and RR (Rural Residential) zoning districts as further described in the staff report and ordinance presented tothe Board ofSupervisors onMay 2G,2D2O;and, WHEREAS, the General Plan BR(SCH#2O080 2062)wascertified omOctober 26,20IQbythe Butte County Board of Supervisors (Resolution 10-150\ and the Supplemental BR (SCH #20138220591) was certified on November 6, 2012 (Resolution 12-123); and, WHEREAS, the Butte County Planning Commission and the Board of Supervisors reviewed and considered the information inthe FSEYRdescribed above, FSEIR administrative record, staff neparts, and all oral and written testimony presented; and WHEREAS, the County has determined that the Amendment to the Zoning Ordinance does not meet the criteria for preparing asubsequent orsupplemental EURunder CE(lA Guidelines Section 15I62;and, WHEREAS an Addendum to the General Plan EIR and Supplementali EIR has therefore been prepared pursuant to CEQA Guidelines Section 15164 for the proposed Zoning Ordinance Amendment; and WHEREAS the Planning Commission held a duly noticed public hearing on April 23,282Uand recommended approval of the EIR Addendum; and, WHEREAS, the Board of Supervisors held, a duly noticed public hearing on May 26, 20,20; and, WHEREAS, the Addendum provides analysis and cites substantial evidence that support's the County's determination that the Amendments to the Zoning Ordinance do not meet the criteria for preparing a subsequent or supplemental E|Runder CEOAGuidelines Section 1S162including: The proposed Zoning Ordinance Amendment would not cause a new significant impact mrsubstantially increase the severity of previously identified significant impact from the (Seoena| Plan E|R or Supplemental EUR /CEQA Guidelines Section 15162[a][11) that vxuu|d require major revisions to either EIR. All [rnpactsm/ou|d be nearly equivalent tVthe impacts previously analyzed inthe General Plan BRand Supplemental BR. Re|atedUy,the Zoning Ordinance Amendments ere not inconsistent with, any of the General Pian policies intended to mitigate environmental impacts. 2. The, proposed Amendments to theZuning Ordinance vvmu|d not cause a new s,ignificamt impact or substantially increase the severity of previously identified significant impact, and there have been no other changes in the circumstances that meet this criterion. As documented in Section 3/0 of the Addendum, there is no new information of substantial importance (which was not known or could not have been known at the time of the General Plan adoption in October 2010, or General Plan Amendment and Zoning Ordinance adoption in November 2812),that identifies: a new significant impact (condition ~A"under CE0WAGuidelines Section 15162[a][3]); asubstantial increase inthe severity ofapreviously identified significant impact (condition °B° CE[A Guidelines Section 15182[a][3]l; mitigation measures or alternatives previously found infeasible that would now be feasible and would substantially reduce one or more significant effects of the General P|am; or mitigation measures oralternatives which are considerably different from those analyzed in the General Plan EVR which would substantially reduce one or more s|gmificant effects nnthe environment (conditions "C"and ~D^CEQAGuidelines Section 15l62[a][3]). NOW THEREFORE, BE[TRESOLVED, that the Board ofSupervisors hereby makes the following findings: 1. Notice of the Board of Supervisors hearing on the Zoning Ordinance Amendments,D5EhRand FSEIR was given es required by law and the actions were conducted in accordance with CEQA, and the State CEQA Guidelines. 2. An Addendum was prepared that provides analysis and cites substantial evidence that support's the County's determination that the proposed Amendments do not meet the criteria for preparing a subsequent or supplemental BRunder CE[y4Guidelines Section 1SI62. 3. All individuals, groups and agencies desiring to comment were given adequate opportunity to submit oral and written comments on the Zoning Ordinance Amendments and the environmental review documents. These opportunities, for comment meet or exceed the requirements of the Planning and Zoning Law and CEQA. 4. The Board ofSupervisors was presented with all of the information described in the recitals and has considered this information in adopting this resolution.
