On August 13, 2019, Licensees received a SWRCB letter stating that the request for water quality certification had been denied without prejudice and that Licensees would need to file a new request for water quality certification. The Environmental Review (CEQA) is scheduled to be completed by the City of Santa Clara by May 2020; therefore, Licensees hereby file this new request for water quality certification for the Bucks Creek Hydroelectric Project This new request for water quality certification adopts by reference all the materials cited in the original request of August 14, 2018, as well as revised proposed license measures and plans submitted to FERC, with copies to the SWRCB, on September 19 and October 3, 2019. The Project consists of two developments— Bucks Creek and Grizzly. In the two developments there are 4 reservoirs, 1 major water conduit, 2 powerhouses, 1 transmission line, and appurtenant facilities and structures, including recreation facilities. On December 16, 2016, the Licensees filed with FERC an application for new license, Final License Application (FLA), for the Project. A copy of the license application was provided to the Board, On May 22, 2018, the Licensees filed with FERC a Supplement to FLA (Supplemental FLA) to update select application exhibits to provide supplemental information that reflects revised proposed protection, mitigation and enhancement measures, or to provide new information that has been developed since the FLA was filed. A copy of the Supplemental FLA was provided to the Board. The Licensees believe the FLA and Supplemental FLA filings contain all information required under § 3856 of Title 23 of the California Code of Regulations in regards to contents of a complete application for a water quality certification. Should the Licensees amend their December 16, 2016 FLA or May 22, 2018 Supplemental FLA, Licensees will promptly provide to the Board a copy of the amended application, as required under § 3834 of the California Code of Regulations.
