ORDER GRANTING EXTENSION OF TIME TO FILE BARDEES BAR TUNNEL
SPOIL PILE REVEGETATION PLAN PURSUANT TO ARTICLE 401
(Issued January 8, 2020)
1. On December 12, 2019, Pacific Gas and Electric Company, licensee for the Poe
Hydroelectric Project No. 2107, filed a request for an extension of time to file a Bardees

Bar Tunnel Spoil Pile Revegetation Plan pursuant to Article 401 of the project license.
The project is located on the North Fork Feather River in Butte County, California. The
project occupies, in part, federal lands administered by the U. S. Forest Service (Forest
Service).
2. On December 17, 2018, the Commission issued a new license for the project.
Article 401 of the license requires the licensee to file for Commission approval various
(California SWRCB) section 401 water quality certificate (WQC) and Forest Service
section 4(e) conditions. WQC condition 15 and 4(e) condition 30 require the licensee to
file a Bardees Bar Tunnel Spoil Pile Revegetation Plan within one year of license
issuance.
3. The plan was to be filed with the Commission on or before December 17, 2019.
The licensee states that it is currently consulting with the California SWRCB and Forest
Service on the plan and additional time is required to complete the consultation and
obtain approval of the plan from the agencies. The licensee therefore requests an
extension until December 31, 2020, to file the plan with the Commission for approval.

California SWRCB and Forest Service and obtain their approval of the plan prior to filing
it with the Commission for approval by December 31,

The Director orders:
(A) , filed on December 12, 2019,
to extend the due date to file a Bardees Bar Tunnel Spoil Pile Revegetation Plan for the
Poe Hydroelectric Project No. 2107, is approved. The due date to file the plan is
extended to December 31, 2020.
(B) This order constitutes final agency action. Any party may file a request for
rehearing of this order within 30 days from the date of its issuance, as provided in section
313(a) of the Federal Power Act, 16 U.S.C. § 825l (2018
regulations at 18 C.F.R. § 385.713 (2019). The filing of a request for rehearing does not
operate as a stay of the effective date of this order, or of any other date specified in this
this order.
