ORDER GRANTING EXTENSION OF TIME TO FILE
RECREATION PLAN PURSUANT TO ARTICLE 404
(Issued January 8, 2020)
1. On December 13, 2019, Pacific Gas and Electric Company, licensee for the Poe
Hydroelectric Project No. 2107, filed a request for an extension of time to file a

Recreation Plan pursuant to Article 404, of the project license. The project is located on
the North Fork Feather River in Butte County, California. The project occupies, in part,
federal lands administered by the U. S. Forest Service (Forest Service).
2. On December 17, 2018, the Commission issued a new license for the project.
Article 404 of the license requires the licensee to file a Recreation Plan, incorporating the
requirements of
section 401 water quality certificate condition 8 and Forest Service section 4(e) condition
26, for Commission approval within one year of license issuance.
3. The plan was to be filed with the Commission on or before December 17, 2019.
The licensee states that it is currently consulting with the California SWRCB, Forest
Service, and other agencies and stakeholders and additional time is required to complete
consultation and obtain approval of the plan from the agencies. The licensee therefore
requests an extension until June 30, 2020 to file the plan with the Commission for

the California SWRCB and Forest Service. Due to a public notice requirement, the

approval of the extension request is included in the filing.
4. Recreation Plan would allow
additional time for the licensee to consult with the California SWRCB and Forest
Service, and as other agencies and stakeholders and obtain their approval of the plans
prior to filing them with the Commission for approval by June 30,

request is reasonable and the due date to file the plans should be extended to
June 30, 2020.
The Director orders:
(A) , filed on December 13, 2019,
to extend the due date to file a Recreation Plan, for the Poe Hydroelectric Project No.
2107, is approved. The due date to file the plans is extended to June 30, 2020.
(B) This order constitutes final agency action. Any party may file a request for
rehearing of this order within 30 days from the date of its issuance, as provided in section
313(a) of the Federal Power Act, 16 U.S.C. § 825l (2018
regulations at 18 C.F.R. § 385.713 (2019). The filing of a request for rehearing does not
operate as a stay of the effective date of this order, or of any other date specified in this
this order.
