CONSENT AGENDA MEMBERS OF THE BOARD STEVE LAMBERT, CHAIR, DISTRICT 4 BILL CONNELLY, DISTRICT 1 DEBRA LUCERO, DISTRICT 2 TAM RITTER, DISTRICT DOUG TEETER, VICE CHAIR, DISTRICT 5 BRUCE ALPERT, COUNTY COUNSEL 3.01 Contract with Megabyte Systems, Inc. for Tax Cycle Software — Since 1988, Megabyte Systems, Inc. has provided the software package for the tax cycle departments in Butte County. The software includes the integrated processing of assessed value, property tax bills and payments. The Assessor's Office, Auditor -Controller's Office, and Treasurer -Tax Collector's Office recommends the Board of Supervisors approve the annual renewal of the Property Tax System Maintenance/Support contract with Megabyte Systems, Inc. for a total of $244,643, plus the provision for extra services including emergency support if requested by the County, with a term beginning July 1, 2020 and ending June 30, 2021. The contract contains an increase of 2.3% from the current year in accordance with the Pacific Cities and U. S. City Average Consumer Price Index — action requested — APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. (Assessor) 3.02 Grant Agreement with North Vallev Communitv Foundation (NVCF) - Butte Strong Fund For Gridley Live Spot Youth Center (GLSYC) — On February 18, 2020, the Butte Strong Committee of the NVCF approved a proposal to fund the GLSYC. The GLSYC is the hub for after school health and wellness services in the Gridley community. GLSYC works with school teachers, counselors, and administrators to make intentional outreach and referrals for the students whose families have relocated to Gridley as a result of the Camp Fire. GLSYC participants report improvement in mental and emotional health, the ability to make good choices as a result of their program participation, increased cultural awareness, improvement in their commitment to academic achievement, increased feeling of safety and inclusion, reduced substance use, and improved relationships with others. The Department recommends entering into a grant agreement with NVCF for the Butte Strong grant funding. The term of the contract is the date of execution through June 30, 2023, not -to -exceed $50,000 — action requested — APPROVE GRANT AGREEMENT AND AUTHORIZE CHAIR TO SIGN. (Behavioral Health) Page 1 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA- MAY 26, 2020 3.03 Agreement with African American Family & Cultural Center (AAFCC) for Outreach Services — The AAFCC integrates African-American culture into the services that focus on early detection, prevention, and awareness of mental health illness in Butte County. These services include: outreach to families, increasing access and linkage to medical care, reducing stigma associated with mental illness, and reducing discrimination against people with mental illness. AAFCC is located in South Oroville, which allows for convenient community engagement in a non - stigmatizing environment. The AAFCC was planned and designed by community residents to address a wide array of issues with the goal of decreasing the impact of historic and current trauma which impact the African-American community. All programs increase the knowledge and skills that reduce the risk factors for the African-American population but all cultures are invited to learn, embrace, and take part in AAFCC activities. The AAFCC aims to establish programs that are connected to "Reclaiming, restoring, and revitalizing the African American culture, heritage, values and identity." The AAFCC outcomes include: provide services to a minimum of 160 clients in the fiscal year, address the Mental Health Services Act required strategies, and manage mental illness symptoms and improve functioning. These services include development of various community programs including book clubs, activities in the arts, a film festival, a talent show, and other events celebrating the culture of the African-American community. The Department of Behavioral Health recommends entering into an agreement with AAFCC for outreach services in South Oroville. The term of the agreement is July 1, 2020 through June 30, 2021, not -to -exceed $359,956 — action requested — APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (Behavioral Health) 3.04 Agreement with Caminar, Inc. (Caminar) for Vocational Rehabilitation and Property Management Services — Caminar is a nonprofit corporation specializing in the planning, development, and operation of vocational rehabilitation programs. Employment services for the Department of Behavioral Health consumers provide a range of services including employment readiness, on-site supportive employment and employment placement assistance, connection to the California Department of Rehabilitation, job training, and community-based employment. A key aspect of recovery is helping the Department's consumers identify ways to live a full life, which often includes re-entry into the workforce. Caminar provides vocational employment development. Both Sensible Cyclery and Pro -touch Cleaning and Yard Maintenance provide consumers with opportunities to develop skills, which enable them to acquire and maintain employment. Caminar outcomes include: assist a minimum of 40 consumers in supported employment vocational training per fiscal year, transition a minimum of six consumers to community employment and/or higher level of vocational services per fiscal year, increase work performance, increase vocational knowledge, and increase the number of participants completing/graduating the vocational training program. The Department recommends entering into an agreement with Caminar for vocational and property management services. The term of this agreement is July 1, 2020 through June 30, 2021, not -to -exceed $331,309 — action requested — APPROVE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (Behavioral Health) 3.05 Contract with Armed Guard Private Security, Inc. for Security Guard Services — Armed Guard Private Security, Inc. provides security guard services for various sites occupied by the Department of Behavioral Health. The Department has been utilizing security guard services due to past threats of violence. Having guards posted at sites has helped staff and clients feel safer while conducting daily activities. The Department recommends entering into a contract with Armed Guard Private Security, Inc. for security guard services. The term of the agreement is July 1, 2020 through June 30, 2021, not -to -exceed $126,758 — action requested — APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. (Behavioral Health) Page 2 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA- MAY 26, 2020 3.06 Agreement Amendment with Netsmart Technologies, Incorporated (NTST) for the Electronic Health Record (EHR)— NTST provides an EHR, which consists of practice management, electronic clinical records, service billing to appropriate payers including Medi -Cal, managed care, eligibility verification, and report writing for both mental health and substance use disorder services. This EHR fully complies with the federal confidentiality standards required by the Health Insurance Portability and Accountability Act of 1996. The Department of Behavioral Health recommends amending the contract with NTST extending the termination date to June 30, 2021 and adding additional licenses. The amendment increases the maximum payable amount by $340,983, not - to -exceed $3,957,729 — action requested — APPROVE AGREEMENT AMENDMENT AND AUTHORIZE CHAIR TO SIGN. (Behavioral Health) 3.07 Cash Advance for Department of Behavioral Health — The Department of Behavioral Health receives funding from a variety of sources throughout the fiscal year. The majority of its funding comes from the State as reimbursements for services. Others are related to realignment funding from sales tax and vehicle license fees. Due to financial impacts of the COVID-19 Pandemic, the Department will receive lower realignment revenues than budgeted for the current fiscal year. Additionally, some realignment revenues and State reimbursements may be delayed to counties. As in previous years, the Department, County Administration, and Auditor -Controller's Office recommend approval of a cash advance from available County funds to the Behavioral Health Fund to eliminate the potential cash deficit as of June 30, 2020. The advance will be transferred back to the impacted Funds on July 1, 2020—action requested —AUTHORIZE AN ADVANCE FROM APPROPRIATE AND AVAILABLE COUNTY FUNDS TO THE BEHAVIORAL HEALTH FUND TO COVER THE POTENTIAL CASH SHORTAGE ON JUNE 30, 2020. (Behavioral Health) 3.08 Approval of Minutes for Board of Supervisors Regular Meeting— Submitted for approval are the minutes for the May 12, 2020 Board of Supervisors Regular Meeting — action requested — APPROVE THE MAY 12, 2020 BOARD OF SUPERVISORS REGULAR MEETING MINUTES AND AUTHORIZE THE CHAIR TO SIGN. (County Administration) 3.09 Contract with California Tree and Landscape Consulting, Inc. for Hazard Tree Inspections — On October 22, 2019, the Board of Supervisors adopted an urgency ordinance requiring property owners to remove hazardous trees burned by the Camp Fire from private property if they pose a threat to fall on public roads or improved public property. On March 10, 2020, the Board adopted an amendment to that ordinance to also require the removal of Hazard Trees on private roads. Property owners may enter the Government Hazard Tree Removal Program or identify and remove trees on their own in compliance with the Private Hazard Tree Removal Program, which currently requires submission of an Inspection Access Form (IAF). The IAF authorizes the County to enter the property to verify that the property owner has removed any and all Hazard Trees as defined in section 53-82 of the Butte County Code. A Request for Proposal was issued on February 7, 2020 for a contractor to provide Certified International Society of Arboriculture Arborists with a Tree Risk Assessment Qualification credential to validate and document that all Hazard Trees have been removed from the parcel. Eight responses were received and California Tree and Landscape Consulting, Inc. was selected as the most qualified firm. County Administration recommends entering into a contract with California Tree and Landscape Consulting, Inc. of Auburn to provide the services required to validate and document parcels enrolled in the Private Hazard Tree Removal Program are in compliance with County Code. The term of the contract is June 1, 2020 through December 31, 2020, not -to -exceed $250,000 — action requested — APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. (County Administration) Page 3 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA— MAY 26, 2020 3.10 Resolution Approving Amendment to the CSAC Excess Insurance Authority (CSAC-EIA) Joint Powers Authority (JPA) Agreement - In 1979, 29 California counties formed the CSAC-EIA to find cost-effective insurance solutions and risk management services for members. Over the years, other California counties, cities, school districts, and special districts have joined the CSAC-EIA including Butte County. In recent years, agencies outside of California have also joined. CSAC-EIA is not affiliated with California State Association of Counties (CSAC). To avoid the confusion, CSAC has requested that CSAC-EIA change its name. The member agencies of CSAC-EIA agreed to change the name of the JPA to Public Risk Innovation, Solutions, and Management, otherwise known as PRISM. The amendment to the JPA agreement changes the name of the organization. County Counsel and County Administration have reviewed the proposed amendments and believe them to be proper — action requested —ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. (County Counsel and County Administration) 3.11 Contract Amendment with Bureau Veritas North America, Inc. for Plan Check and Inspection Services — The County entered into an agreement with Bureau Veritas North America, Inc. on April 29, 2015 for building services including permit application, plan check, and inspection services as needed by the Department of Development Services. The contract was amended in 2016 to increase the total amount payable and extended the term. Contracting building permit services allows the Department to provide timely service to the public when there is a high demand for building -related permits. The Department recommends the Board of Supervisors amend the contract with Bureau Veritas North America, Inc. to extend the term of the contract by six months, through December 31, 2020. All other terms and conditions remain the same. The termination date change will align with the other building services contracts, which will allow for a single Request for Proposals when soliciting for these services — action requested — APPROVE CONTRACT AMENDMENT AND AUTHORIZE CHAIR TO SIGN. (Development Services) 3.12 Contract Amendment with ABC Nick's Pioneer Towing for Abandoned Vehicle Abatement (AVA) Towing — The AVA towing program allows abandoned vehicles left in the public right-of-way to be towed away. The County entered into a contract with ABC Nick's Pioneer Towing on May 1, 2016, and amended the contract in 2018 to add rates for oversized vehicles. ABC Nick's Pioneer Towing is the County's sole company for the AVA Program. The number of vehicles abated by the AVA Program in the County has increased, and an increase to the contract with ABC Nick's Pioneer Towing is necessary for the volume of additional tows. The Department of Development Services recommends the Board of Supervisors amend the contract with ABC Nick's Pioneer Towing to increase the maximum payable amount by $100,000, not -to -exceed $200,000. All other terms remain the same. The County pays for removal of abandoned vehicles through the AVA Program and is reimbursed by the State through the locally imposed vehicle registration fee — action requested — APPROVE CONTRACT AMENDMENT AND AUTHORIZE THE CHAIR TO SIGN. (Development Services) 3.13 Contract with PlaceWorks for the Climate Action Plan (CAP) Update — On November 19, 2019, the Board of Supervisors adopted Resolution No. 19-304 authorizing the County to apply for Senate Bill (SB) 2 (Building Homes and Jobs Act) grant funding from the State Department of Housing and Community Development (HCD). The County was awarded funding for a CAP update. The Department of Development Services issued a request for proposal and selected PlaceWorks in Berkeley as the most qualified firm. The project includes preparation of a greenhouse gas inventory and the CAP update. The Department recommends entering into a contract with PlaceWorks for the CAP Update. The term of the contract is upon execution through December 31, 2020, not -to -exceed $202,085. —action requested—APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. (Development Services) Page 4 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA- MAY 26, 2020 3.14 Land Conservation (Williamson Act) Consistency Review of a Minor Use Permit Application for an Events Facility on Cana Highway — The Williamson Act Advisory Committee reviewed Minor Use Permit MUP19-0006 (Masonek) on March 2, 2020 and found it will not impair the use of the property for agriculture (walnut orchard and production) and is consistent with the Williamson Act and the Butte County Administrative Procedures and Uniform Rules for Implementing the Williamson Act. The Committee's finding includes a recommended condition to include an agricultural disclosure statement as part of the facility rental agreement. The Minor Use Permit allows for an events facility, which includes weddings. The parcel is approximately 36.1 acres size. The proposed events facility would constitute 0.75 acres, which is approximately 2% of the parcel. The property is currently in use as a walnut orchard and is developed with 2 dwellings, one with an attached garage, and three accessory structures (garage, pool house with an indoor pool, and a shed). The second dwelling is approved as an agricultural worker dwelling. Parking is proposed in the front portion of the parcel. The Zoning Administrator will review the minor use permit. The Zoning Administrator's approval is conditional pending a determination by the Board of Supervisors that the use is consistent with the Williamson Act — action requested — DETERMINE THAT ALL REQUIRED FINDINGS CAN BE MADE REGARDING THE CONSISTENCY OF MUP19-0006 (MASONEK) WITH THE WILLIAMSON ACT. (Development Services) 3.15 Resolution Reco2nizin2 Emilia Erickson for Her Contributions to the Communities of Concow and Yankee Hill — Supervisor Connelly requests the Board of Supervisors adopt a resolution recognizing Emilia Erickson for her contributions to the communities of Concow and Yankee Hill — action requested — ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. (District 1 Supervisor Bill Connelly) 3.16 Resolution Authorizing Execution of Agreement with California Victim Compensation Board CalVCB — CalVCB pays for the immediate needs of victims of crime by using a local revolving fund, governed by an agreement with CalVCB and operated by the Victim Assistance Bureau of the District Attorney's Office. Pursuant to the requirements of the agreement, the District Attorney's Office recommends the Board of Supervisors adopt a resolution authorizing the District Attorney to enter into the agreement with CalVCB, and further authorizes the District Attorney to execute any amendments, extensions and other supporting documentation required by the terms of the agreement. The term of the agreement is July 1, 2020 through June 30, 2023 — action requested — ADOPT RESOLUTION AND AUTHORIZE CHAIR TO SIGN. (District Attorney) 3.17 Contract with Valley Oak Children's Services (VOCS) forthe Emergency Child Care Bridge Program VOCS is a nonprofit organization that provides emergency childcare to eligible families and trauma -informed care training and coaching to childcare programs participating in the Bridge Program. The Bridge Program is designed to eliminate any childcare barriers related to placement of children in the child welfare system. One of the primary barriers for potential families seeking to take in a foster child is the lack of access to childcare immediately following the placement of the child. Under the terms of the agreement, VOCS has the measurable goal of providing access to emergency childcare bridging services to all foster family referrals made by the Department of Employment and Social Services. Payment is made on an actual cost basis for allowable activities. In the first 10 months of Fiscal Year 2019-20, the Emergency Child Care Bridge Program received referrals for 53 children and 52 of those children received or are receiving services. The Department recommends entering into a contract with VOCS to provide Emergency Child Care Bridge Program Services to families in the child welfare system. The term of the contract is July 1, 2020 through June 30, 2021, not -to -exceed $186,136— action requested — APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. (Employment and Social Services) Page 5 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA- MAY 26, 2020 3.18 Budget Adjustment and Ratify Agreement with the State of California Business, Consumer Services, and Housing Agency (BCSH) for COVID-19 Emergency Funding — BCSH awarded $100 million in funds through a one-time grant to Continuum of Care agencies, large cities, and counties to protect the health and safety of homeless populations and reduce the spread of the COVID-19 outbreak. Funding was divided proportionally based on the allocations that regions were eligible to receive through the Homeless Housing, Assistance, and Prevention Program with $473,709 designated for Butte County. As time was of the essence in executing the agreement so that services could begin immediately, the agreement was signed by the Director of Employment and Social Services. The Department of Employment and Social Services recommends that the Board of Supervisors ratify the agreement between Butte County and BCSH. The term of the agreement is from April 6, 2020 through June 30, 2020. Additionally, the Department recommends approving a related budget adjustment — action requested — 1) APPROVE AGREEMENT AND RATIFY DIRECTOR OF EMPLOYMENT AND SOCIAL SERVICE'S SIGNATURE; AND 2) APPROVE BUDGET ADJUSTMENT (4/5 VOTE REQUIRED). (Employment and Social Services) 3.19 Communications Vault License Agreement with DigitalPath, Inc., for the Flea Mountain Site — On February 25, 2020, the Board of Supervisors approved a not -to -exceed $30,000 Memorandum of Understanding with DigitalPath Inc. to install grounding equipment at the Flea Mountain site. In addition, the Board approved an agreement also with DigitalPath Inc. with a term beginning February 25, 2020 through February 28, 2023 with monthly payments of $1,800 for the County to occupy a portion of the Flea Mountain site. Subsequent to execution by the County, Counsel for DigitalPath Inc. required three changes to the agreement: 1) To ensure internal consistency within DigitalPath Inc. records, capitalization and formatting that does not alter the contractual obligations were made; 2) The original Section 10 was eliminated that granted the County the first right to acquire in the event the site is to be sold; and 3) A sentence was added to Exhibit B clarifying frequencies that may be operated at the site. The Department of General Services and the Department of Information Systems recommend that the Board approve the updated agreement so the grounding work can proceed and the County can occupy a portion of the Communications site — action requested — APPROVE COMMUNICATIONS VAULT LICENSE AGREEMENT AND AUTHORIZE THE CHAIR TO SIGN. (General Services and Information Systems) Page 6 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA- MAY 26, 2020 3.20 Resolution to Amend the Salary Ordinance —The Department of Human Resources recommends the Board of Supervisors adopt a resolution amending the Salary Ordinance for the following departments: HUMAN RESOURCES: Amend Section 28E of the Salary Ordinance No. 4179 of the County of Butte entitled "Butte County Management and Supervisory Unit (BCMEA)" by adding the Class Code 9545 "Compliance Officer, Behavioral Health" Range 66, and Class Code 9550 "Quality Care Management and Systems Performance Manager" Range 66. These new classifications are needed to meet additional State and federal mandates in compliance and reporting. The County faces the possibility of sanctions if certain structures are not in place in the delivery of behavioral health services. BEHAVIORAL HEALTH: Add 1 Compliance Officer, Behavioral Health position and 1 Quality Care Management and Systems Performance Manager position, and delete 1 vacant Deputy Director, Behavioral Health position. These changes are requested to meet State and federal mandates. Total allocations to increase by 1. Funding for these positions has been identified within the Fiscal Year 2019-20 budget and included in the Fiscal Year 2020-21 budget request with no impact on the General Fund Budget. Action requested — ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. (Human Resources) 3.21 Grant Agreement with California Department of Public Health (CDPH) for the Sexually Transmitted Disease (STD) Program Management and Collaboration Project — The Department of Public Health recommends entering into a grant agreement with CDPH for the STD Program Management and Collaboration Project. This grant is an expansion of a current CDPH program administered by the Department. Per the scope of work, the Department will utilize funds to enhance and implement public health activities to monitor, investigate, and prevent STDs in collaboration with community-based organizations within the County. Key strategic targets for STD prevention and control are: enhancement of surveillance and case follow up for syphilis cases; testing, treatment, partner services, and referrals to services for vulnerable and underserved clients at high risk for STDs; and implementation of community-based services through partnerships with community-based organizations. The term of the grant agreement is from the date of full execution (estimated to be in June 2020) through June 30, 2024 with a maximum receivable amount of $795,330 — action requested — APPROVE GRANT AGREEMENT AND AUTHORIZE CHAIR TO SIGN. (Public Health) 3.22 Ratify Contract Change Order (CCO) and Approve Notice of Completion for Module 5, Phase C Excavation, Phase II at the Neal Road Recycling and Waste Facility — On January 14, 2020, the Board of Supervisors awarded the Module 5, Phase C Excavation, Phase II at the Neal Road Recycling and Waste Facility Project to DeSilva Gates Construction, LP, of Dublin. The project included clearing and grubbing, excavation, general fill, and storm drain installation. The contract award amount was $971,000. CCO No. 1 provides for minor changes in quantities to match the actual installed quantities. The net change of CCO No. 1 is a decrease in the contract amount of $22,208.95. Total cost of work including the contract change order is $948,791.05. All contract work has been completed in accordance with the project plans and specifications — action requested — 1) RATIFY CCO NO. 1; AND 2) ACCEPT THE CONTRACT WORK AS COMPLETE AND AUTHORIZE THE CHAIR TO SIGN THE NOTICE OF COMPLETION. (Public Works) Page 7 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA- MAY 26, 2020 3.23 Authorization to Advertise and Bid the Off -System Emergency Road Guardrail Repairs Due to Camp Fire for Pulga Road —As a result of the Camp Fire, Pulga Road sustained extensive guardrail damage. Federal Disaster Declaration, FEMA 4407 DR CA, makes the County eligible to submit a claim for reimbursement for this work to the FEMA Disaster Assistance Program. The engineer's estimate for the damaged guardrail repairs on Pulga Road is $250,000. The Department of Public Works recommends the Board of Supervisors authorize the Department to advertise and solicit bids f for the Off -System Road Guardrail Repairs due to the Camp Fire for Pulga Road; County Project 533-5319-06 — action requested — AUTHORIZE THE DIRECTOR OF THE DEPARTMENT OF PUBLIC WORKS TO ADVERTISE AND BID THE PROJECT. (Public Works) 3.24 Authorization to Advertise and Bid the La Porte Road Emergency Relief (ER) Repair Project — The La Porte Road ER Repair Project, County Project No. 533.2020.07, will provide for removal of damaged pavement sections with dig -outs and repaving of a new asphalt driving surface on La Porte Road from the intersection at Oro Bangor Highway in the community of Bangor to Quarry Road. Total project length is approximately 0.40 miles. This repair work is necessary due to damage caused by the emergency response during the Oroville Spillway incident. Federal emergency relief funding was recently released that will allow this and several other projects to move forward. The engineer's estimate for construction is $400,000 for this section of roadway. The total project cost is $415,000, which includes preliminary engineering, construction, and construction engineering. The Department of Public Works recommends the Board of Supervisors authorize the Department to advertise and solicit bids for the construction of the La Porte Road ER Repair Project — action requested —1) AUTHORIZE THE PROJECT; 2) APPROVE THE PLANS AND SPECIFICATIONS; 3) AUTHORIZE THE CHAIR TO SIGN THE PLANS; AND 4) AUTHORIZE THE DIRECTOR OF PUBLIC WORKS TO ADVERTISE AND SOLICIT BIDS FOR THE CONSTRUCTION OF THE PROJECT. (Public Works) 3.25 Authorization to Advertise and Bid the Oro Bangor Road Emergency Relief (ER) Repair Project - The Oro Bangor Road ER Repair Project, County Project No. 533.2019.05, will provide for replacement of the subgrade road structural section and repaving of a new asphalt driving surface on the Oro Bangor Highway from Miners Ranch Road to La Porte Road at the community of Bangor. Total project length is approximately 6.50 miles. This repair work is necessary due to damage caused by the emergency response during the Oroville Spillway incident. Federal emergency relief funding was recently released that will allow this and several other projects to move forward. The scope of work will include the complete re -build of the existing roadway and structural section that supports the driving surface. The engineer's estimate for construction is $3,846,400 for this section of roadway. The total project cost is $3,856,400, which includes preliminary engineering, construction, and construction engineering. (Public Works) Page 8 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA- MAY 26, 2020 3.26 Authorization to Award Contract to MCM Construction, Inc., for the Midway Road Bridge Replacement Project — On December 16, 2010, the County entered into an agreement with the California Department of Transportation to complete the Midway Road Bridge Replacement Project, Federal Project BRLS-5912(085). The project is located on the Midway across Butte Creek and the Butte Creek Overflow channel. The project will involve the replacement and subsequent removal of two existing bridges originally constructed in 1915 and 1918. A new 1,404 foot highway bridge will be constructed on the existing alignment spanning both Butte Creek and the Butte Creek Overflow channel, and will necessitate the closure of the Midway to traffic until the new bridge is complete. The engineer's estimate at the time of bidding this project was $21,875,114. The authorization to award the contract was scheduled to be considered by the Board of Supervisors at the May 12, 2020 Board Meeting, but was pulled from the agenda because the second bidder, Meyers -George Reed, filed a formal bid protest, and there was not adequate time to address the concerns listed in the protest prior to the meeting. Since that time, a full and complete analysis was performed in conjunction with County Counsel's Office. All of the items listed in the protest have been appropriately addressed and it has been determined that the bid protest is without merit. In addition, MCM Construction, Inc. has identified one clerical error it made in filling out its bid proposal and it has been determined that the error is a minor irregularity which is immaterial and should be waived. This project was advertised and posted on Publicpurchase.com on April 1, 2020, and a total of six bids were received on April 23, 2020, ranging from a low of $19,600,643.50 to a high of $22,492,188. The lowest responsive and responsible bidder was MCM Construction, Inc., of North Highlands with a bid amount of $19,600,643.50. The contract allows 260 working days for completion of the project starting upon issuance of the Notice to Proceed. The Department recommends that the Board waive the minor bid discrepancies, and authorize awarding the contract to MCM Construction, Inc. —action requested — 1) WAIVE ALL MINOR BID IRREGULARITIES AS IMMATERIAL AND AWARD THE CONTRACT TO MCM CONSTRUCTION, INC.; AND 2) AUTHORIZE THE DIRECTOR OF PUBLIC WORKS TO SIGN THE CONTRACT. (Public Works) 3.27 Resolution Authorizing the Director of the Department of Public Works to Execute the Program Supplement Agreement with the State Department of Transportation (Caltrans) for the Local Road Safety Plan (LRSP) Project — On May 5, 2009, the Board of Supervisors approved the Master Agreement, Administering Agency -State Agreement for State Projects, No. 002485 with Caltrans for County projects receiving State aid from the California Transportation Commission (CTC). This Master Agreement is necessary to incorporate and conform to changes in State statutes, regulations, and policies. A resolution authorizing the Director of the Department of Public Works to sign Program Supplement Agreements is required for each project. The Department recently received a Program Supplement Agreement for the Local Road Safety Plan (LRSP) Project LRSPL-5912 (120). This is a pilot project intended to supplement the Highway Safety Improvement Program (HSIP) and further the goals of the HSIP program to reduce fatal and serious injury traffic collisions. The project will develop a safety plan to incorporate and guide decisions on HSIP projects within future grant applications, and will help supplement the project goals and define threshold triggers that will activate responses to minimize those fatal and serious injuries. Although this plan is not required for the upcoming HSIP Cycle X grant applications in 2020, the plan will be a requirement in the HSIP Cycle XI grant application in 2022. Caltrans is now providing funding via this project to aid agencies in the cost to derive such plans into implementation. The estimated cost of the project is $80,000 and 90% of the costs are paid by State funding — action requested —ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. (Public Works) Page 9 BUTTE COUNTY BOARD OF SUPERVISORS AGENDA— MAY 26, 2020 3.28 Contract with M.T. Hall and Associates for Materials Testing Services — During the construction of capital projects, the Department of Public Works utilizes specialized services to perform quality control on materials provided by contractors. These testing services should be separate from the contractor's quality assurance process to avoid any potential conflicts of interest. Services follow specific testing protocols and utilize specialized testing devices. The Department expects the proposed contract to provide testing services for up to fifteen different capital projects over the next three years. The Department released a request for proposals on January 21, 2020 for on-call materials testing services to provide construction materials testing for capital improvement projects. Five firms submitted proposals and the Department reviewed and ranked each proposal based on cost and qualifications. The Department determined that M.T. Hall and Associates of Chico scored the highest to perform these material testing services. The Department recommends entering into a contract with M.T. Hall and Associates for on-call materials testing services. The term of the contract is May 26, 2020 through August 31, 2023, not -to -exceed $140,000 — action requested — APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. (Public Works) 3.29 Contract with Quincy Engineering for Design Services on the 2019 Dark Canyon Storm Damage — The Department of Public Works recently issued a Request for Qualifications (RFQ) to establish a list of firms to provide engineering design services for the analysis and repair of the 2019 Dark Canyon Storm Damage sites. The RFQ process established a list of six firms with the necessary qualifications to perform this type of work. The proposals were reviewed and scored by Department staff and ranked as to the ability and expertise to perform the work. Quincy Engineering from Rancho Cordova was ranked the highest and selected to submit a scope and budget to perform the work. The scope of services for this contract includes engineering surveying, geotechnical analysis, environmental clearances and permitting, design, cost estimates, and other services as necessary for the 2019 Dark Canyon Road Storm Damage Repair Project. The term of the contract is three years from the date of execution, not -to -exceed $534,300. It should be noted that this initial estimate is strictly for analysis and proposed structural solutions. Complete design calculations, design checks, and plans and specifications will be an amendment to this contract upon FEMA approval at a later date — action requested — APPROVE CONTRACT AND AUTHORIZE THE CHAIR TO SIGN. (Public Works) 3.30 Contract Amendment with Gallaway Enterprises for Bat and Bird Exclusionary Measures Related to the Midway Bridge Replacement — On February 6, 2020, the Department of Public Works entered into a contract with Gallaway Enterprises to provide bat and bird exclusionary measures on the Midway Bridge crossing Butte Creek which will be replaced this summer. These measures are critical, as establishment of bat and/or bird nests underneath this structure could render it "off limits" to construction activities this year. The initial contract amount was established at $24,229. The scope of the contract provided for intermittent monitoring and removal of partially constructed swallow nests, on a time and materials basis, until this responsibility could be passed to the Bridge Contractor. Staff had initially planned to have a contractor on board by May 1, 2020. Unfortunately, authorization to advertise for bids for the bridge replacement was not received in time to meet the planned construction start date. Additionally, the structure has experienced a significant increase in the volume of swallows attempting to nest underneath the bridge. This has required the consultants to visit the site daily to clear the partially constructed nests and increased the costs to keep the bridge structure "ready for construction". The Department recommends amending the contract with Gallaway Enterprises for bat and bird exclusionary measures on the Midway Bridge crossing Butte Creek. This amendment increases the maximum amount payable by $24,480, not -to -exceed $48,709. In accordance with the California Commission on Peace Officer Standards and Training requirements, this service must be performed by a licensed mental health clinician versed in the psychological screening procedures and standards. The Sheriff's Office recommends entering into a contract with Cordico for law enforcement pre-employment psychological assessments. The Sheriff's Office currently contracts with KW Smith for transportation of remains to and from Sacramento County Coroner facilities and mortuaries. Costs related to transportation services have exceeded original estimates and the maximum amount payable under the contract needs to be increased. The Sheriff's Office recommends amending the contract with KW Smith for mortuary transportation services. The amendment increases the maximum payable amount by $90,000, not -to -exceed $144,999. (Sheriff -Coroner) 3.33 Agreement with Tyler Technologies (Tyler) for Civil Software Purchase and Implementation —The Sheriff's Office completed a solicitation for new civil software and implementation services due to existing software reaching end of support by the developer. Tyler was the lowest priced and most responsive bidder. The agreement is for the purchase of software licenses, implementation of the new system, support and maintenance, and training for staff. Due to the cost of the software licenses and implementation, the software is considered a capital asset. The Sheriff's Office recommends entering into an agreement with Tyler for civil software capital asset purchase and implementation services. The term of the agreement is from date of execution through five years, not -to -exceed $163,339. (Sheriff -Coroner) 3.34 Ratify Agreement with California Department of Parks and Recreation and Resolution Authorizing Application for the Division of Boating and Waterways (DBAW) Boating Safety and Enforcement Aid Program —The Sheriff's Office was awarded grant funding from DBAW for year- round patrols of the Feather River, Sacramento River, and Lake Oroville. The Sheriff is charged with the enforcement of boating laws and regulations by means of vessel, foot, and vehicle patrol. Uniformed law enforcement personnel will provide year-round patrols on all waterways, provide education to the public on State and local boating laws, conduct vessel inspection programs for compliance with required safety equipment and vessel registration, as well as, provide supervision of on -the -water boating activities. The program funds a full-time uniformed deputy sheriff, a leased patrol vehicle, marine equipment, and supporting program services. The State requires the County to utilize annual boat tax revenue of $92,754, which is used to partially fund a full-time Sheriff's Sergeant to oversee the water enforcement program. The State also requires a resolution in support of the Boating Enforcement Program. Funds must be utilized to prevent, prepare for, and respond to the Coronavirus pandemic. These efforts include purchase of supplies needed to protect deputies and non -sworn staff from the virus. (Sheriff -Coroner) 3.36 Contract Amendment with Ontario Systems LLC (Ontario) for Mailing Services — The Treasurer - Tax Collector's Office has used Ontario collection software, Columbia Ultimate Business Systems (CUBS), since 2001 to mail customer letters initiated by revenue and reimbursement officers in the course of their daily work. The Department uses the CUBS collection software to service the Superior Court and the County's delinquent debt portfolio. The contract covers the costs of printing and mailing approximately 75,000 collection letters per year. The current contract has been in place since July 1, 2015. The Department recommends amending the contract with Ontario for mailing service. The amendment extends the term of the contract by one year through June 30, 2021, and increases the maximum payable amount by $40,000, not -to -exceed $252,000. Consent Agenda: these are items that are considered routine and are handled by one motion and vote of the District Attorney*: Board. If you wish to discuss any item on the Consent Agenda you can either fill out a speaker card (located in Mike Ramsey the back of the board room) and give it to the Clerk of the Board (sitting to the right of the Board) or, when the Employment & Social Chair asks if there is anything anyone would like to remove from the Consent Agenda, stand and approach the Services: podium and request the item be removed. The removed items are discussed at the end of the Regular Agenda. Shelby Boston 2. Regular Agenda: this is where presentations to the Board and items that require full discussion are heard. Items Fire Chief: removed from the Consent Agenda are discussed under this section. David Hawks 3. Public Hearing and Timed Items: this is where items that are required by law to be heard as a public hearing are set. This is the section where appeals before the Board are usually discussed. Public Comment: this is the area of the agenda where members of the audience may address the Board on any Human Resources: matter not listed on the agenda.
