The project occupies 144 acres of federal land within the Plumas National Forest administered by the U.S. Department of Agriculture, Forest Service. 2.The Commission’s rehearing order added Article 407to the license.Article 407 requires the licenseeto conductwithin 9 months of license issuance, a feasibility study on improving an existingabandoned trail between Bardees Bar and the Poe powerhouse road and compare the results of this study withthe information provided in the licensee’s September 2006feasibility report on modifying the abandoned construction road, upstream of Bardees Bar,for use as a trail; and if feasible, based on the results of the study, include in the Recreation Plan a schedule for constructingan all-weather hiking trail in one of the twolocations. 3.On September 17, 2019, the licensee filed thefirst extension of time request to complete the feasibility studyand to develop alternatives to the repair and long-term maintenance of Bardees Bar Road and a schedule for construction the trail, ifdetermined to be feasible. Commission staff subsequently granted the request in an order dated October 22, 2019,which extendedthe deadline to file the results of the feasibility study with the Commission to January 31, 2020. The October 22, 2019 order also extended the deadlinefordeveloping alternativesto the repair and long-term maintenance of Bardees Bar Road and a schedule for constructing the trail, if determined to be feasible, to July31, 2020. 1 167FERC ¶ 61,047 (2019). Project No. 2107-021 -2- 4.The licensee states in its February 3, 2020 filing thatButte County Resource Conservation District had not provided the draft study until November 11, 2019, since additional time was needed to refine estimated construction costs. The licensee provided an electronic copy of the draft feasibility study to stakeholders on December 9, 2019 and subsequently received comments on the study. The licensee states thatit needs additional time toaddressthese commentsandtoconsult with stakeholders. Additionally, the licensee states that it discoveredinadequacies with respect to the preliminary cost estimatesincludedin the draft study, and that it needs to initiate an additional estimation process. 5.The licensee requests that the due date to file the final feasibility study withthe Commission be extended to correspond with the previously extended due date established in the October 22, 2019 order forfilinga schedule for constructing the trail ifthe trailis determined to be feasible (i.e., July31,2020).The licensee states that, in a meeting with stakeholders on January 23, 2020, the stakeholders voiced support for an extension of time request to complete and incorporate an adequate estimation of permitting costsand that they requested additional time tocomment on the final recommendation regarding thefeasibility of the trail, including appropriate cost estimates, before it is submitted to the Commission. 6.Thelicensee’srequestis justified and reasonable and is supported by the necessary stakeholders.Therefore, the request should be approved. The Director orders: (A)Pacific Gas and Electric Company’ssecond requestto extend the deadline tofilethe trail feasibility studyfor the Poe Hydroelectric Project No.2107,filed on February 3, 2020,pursuant to Article 407of the Order Granting Rehearing,is approved. The deadlineto(1)filethe resultsof the feasibility studyand comparisons to the 2006 study; and (2)develop alternatives to the repair and long-term maintenance of Bardees Bar Road and a schedule for constructing the trail, if determined to be feasible, is July31,2020.If determined to be feasible, the schedule for constructing the trail must be filed as an addendum to the Recreation Plan. Project No. 2107-021 -3- (B)This order constitutes final agency action.Any party may file a request for rehearing of this order within 30 days from the date of its issuance, as provided in section313(a) of the Federal Power Act, 16 U.S.C. § 825l(2018), and the Commission’s regulations at 18 C.F.R.§ 385.713 (2019).The filing of a request for rehearing does not operate as a stay of the effective date of this order, or of any other date specified in this order.The licensee’sfailure to file a request for rehearing shall constitute acceptance of this order.
