Subject: Request for concurrence with endangered species determinations under
section 7 of the Endangered Species Act
Dear Ms. Norris:
The purpose of this letter is to supplement our request for your concurrence with
our endangered species determination under section 7 of the Endangered Species Act for
the Bucks Creek Hydroelectric Project No. 619. By letter dated December 30, 2019,
Federal Energy Regulatory Commission (Commission) staff requested your concurrence
with our determination regarding effects to the federally-listed Sierra Nevada yellow-
legged resulting from the proposed dewatering of Lower Bucks Reservoir and
related construction activities to support the installation of a geomembrane liner on the
upstream face of the dam. By letter dated January 29, 2020, U.S. Fish and Wildlife
Service (FWS) staff requested additional information to complete consultation. The
hydroelectric project is located on Bucks Creek, Grizzly Creek, Milk Ranch Creek, and
the North Fork Feather River in Plumas County, California.
The licensees (Pacific Gas and Electric Company and City of Santa Clara) have
prepared additional information in response to the FWS’s request. This information is
contained in 2 letters and supporting documentation, filed with the Commission on
Project No. 619-167 -2-

February 18 and March 19, 2020. We accept this additional information and provide it
as a supplement to biological assessment sent to your agency on December 30, 2019
(hyperlinks are provided below).
As stated in our December 30, 2019 letter, we conclude that the proposed action,
with the included best management practices, “may affect but is not likely to adversely
affect” the Sierra Nevada yellow-legged frog or its critical habitat. Therefore, we do not
believe that formal consultation is required under the Endangered Species Act. Please
tell us in writing if you do or do not agree with our assessment.
