I understand he has contacted at least 3 Supervisors so, I want to make sure that you all have the information concerning the situation. Our Code Enforcement Division, received a compliant of someone building without permits during the first week of March. The Officer did a site visit and verified that work was being done without permits and red tagged the building. Our Building Official has been in contact with the contractor, Jim Minto, directly and has instructed him he needs to submit plans and obtain a building permit. A few things to note on this case. First, the person involved is a LICENSED contractor and therefore, knows he needed a permit before beginning work. Second, this is a building in the floodplain. It appears there was a building previously on the site that the contractor tore down to replace-thus removing any non-conforming status of the original building. Our staff has informed this contractor that he can build a replacement building, but that it must go through the process and be permitted. Because it is in the floodplain, any habitable space would have to be built about the flood elevation one foot. He will need to get the certified flood elevation for the area in order for that elevation to be set. The ag portion of the building would also need to be modified, as per the Code, to have the appropriate floodplain materials. He has continued to work after the red-tag and is furthering the expense to the corrective measures he will need to make. We will continue to work with this individual to get him through the permit process, but it seems he is looking for a political solution to a Code problem that he has created by working without first obtaining a building permit.
