The draft treatment plan will be attached to the Programmatic Agreement between the Federal Energy Regulatory Commission and the California State Historic Preservation Officer Regarding Installation of a Carpi-Liner on the Lower Bucks Lake Dam, Bucks Creek Hydroelectric System (FERC NO. 619-167) Plumas County, California. The Federal Energy Regulatory Commission (FERC) consults pursuant to Section 106 of the National Historic Preservation Act of 1966 (54 U.S.C. § 300101), as amended, and its implementing regulation found at 36 CFR § 800. Following review of the treatment plan I offer the following comments: Please clarify what is meant by recommendations at the "close of treatment" in Section 6.2.3.2; Please clarify what circumstances would allow for formal evaluation of archaeological discoveries versus treating them as eligible without formal evaluation; I recommend increasing comment periods on proposed treatment of discoveries and other instances requiring comment from 1-day to 2-days; I recommend inserting "in consultation" to statement in Section 6.2.4.2 that states, "if a resource is considered ineligible (in consultation) it will be given no further consideration under the PA" I recommend adding sections to the Treatment Plan that discuss and outline procedures for both archaeological and Native American Tribal monitoring during ground disturbing and/or other construction activities that might warrant monitoring; Ms. Andrea Claros FERC_2019_0826_001 April 17, 2020 Page 2 of 2 I recommend adding a section that discusses evaluating significance of discoveries under National Register criteria A, B, and or C.
