Daneluk, AICP, Director Pete Calarco, Assistant Director 7 County Center Drive T: 530.552.3701 Oroville, California 95965 F: 530.538.7785 buttecounty.net/dds August 31, 2020 Dear Umpqua Bank: Subject: Burn Down letter for 068-140-070 The above referenced parcel, APN 068-140-070 with the address of 4516 Olive Highway, Oroville, CA 95966, is currently zoned Mixed Use (MU-2). The MU zone permits Single-Family and Accessory Dwellings by right (without additional land use entitlement). The existing 1,064 sq. ft. dwelling, built in 2012, has not been permitted as an Accessory Dwelling Unit as the structure had been built prior to the County’s adoption of the Second Units and Accessory Dwelling Units section passed on January 1, 2020. The County recognizes the existing structure as a legal non-conforming use. Please refer to Chapter 24 of Butte County Code, Article 2, Division 4. (Commercial and Mixed Use Zones) and see Table 24-22 Permitted Land Uses in the Commercial and Mixed Use Zones. Under “Residential Uses” please note that the Land Use Category of “Single-Family Home” is permitted in the MU Zone, however, Second Units and Accessory Dwellings are stated as not permitted. This refers to code prior to January 1, 2020. The State of California recently passed a bill which requires cities and counties to permit accessory dwelling units by right for any zone which allows for single-family and multi-family dwellings. This includes Butte County’s Mixed Use district. Please see Senate Bill 13 (SB-13) for more detailed information of the provisions. If the additional dwelling unit is destroyed, per SB-13, rebuilding is possible by obtaining the appropriate Building Permits.
