HomeMy WebLinkAboutVariance Letter 462 Bay Tree Drive December 30, 2019 John Caddie, Fire Captain CAL Fire-Butte County Fire Department 176 Nelson Avenue Oroville, CA, 95965 RE: 462 Bay Tree Drive, Paradise, CA 95969 APN: 055-540-047 Captain Caddie, The California Board of Forestry and Fire Protection SRA Fire Safe Regulations Section1270.08, allows us to request a variance for property listed above to the authority having jurisdiction. Please consider my request for a variance per the California Board of Forestry and Fire Protection SRA Fire Safe Regulations section 1276.01. Section 1276.01(a) states: That for parcel one acre and larger, a minimum 30 foot setback for buildings and accessory buildings is required and Section 1276.01(b) states: For parcels less than 1 acre, the local jurisdiction shall provide for the same practical effect. I have attached a proposed site plan providing additional detail to clarify the requested variance. On the attached site plan, 462 Bay Tree Drive, the shape of the property and the slope of the backyard designated as a non-designated building area prevent the home from meeting the required setbacks. To mitigate fire concerns, I have provided 100 feet of defensible space to the rear of the property and to each property line for the width of our property. I do thoroughly understand and have great appreciation for defensible space and will ensure that this proposed variance does not present an additional fire hazard or risk to my property.
