HomeMy WebLinkAbout20-098WHEREAS, Section 99', Subdivision (b), Paragraph, (5) of the Revenue and Taxation Code provides as follows: In the
event that a jurisdictional change would affect the service area or service responsibility of one or more special districts, the
board of supervisors of the county or counties in which the districts are located shall, on behalf of the district or districts,
negotiate any exchange of property tax revenues; and
WHEREAS, on August 6, 2020, the Butte Local Agency Formation Commission (LAFCo) adopted Resolution No. 01
20'22/21 approving LAFCo File No. 20-06 — Reorganization - Oroville Mosquito Abatement District Dissolution and
Annexation to the Butte County Mosquito and Vector Control District, which dissolved the Orovillle Mosquito Abatement
District (OMAD) and annexed approximately 7,660 acres of service territory to the Butte County Mosquito and Vector
Control District (BCMVCD) thus transferring the responsibility for mosquito abatement services in this area to BCMVCD;
and
WHEREAS, LAFCo determined this transfer of mosquito abatement services from OMAD to BCMVCD should
include the following: "A Master Property Tax Sharing. Agreement is in affect with Butte County that does not transfer any
County share of property tax to the District. OMAD's ad -valorem property tax revenue collected from the parcels within
the territory shall be reassigned to BCMVCD"; and
WHEREAS, the Butte County Board of Supervisors has written a letter to the District Board Members and Executive
Officers of OMAD and BCMVCD that notifies them of the Board's role in the process, identifies how the Board intends to
proceed including the proposed resolution the Board may adopt, and requests any comments the districts may have; and
WHEREAS, the Butte County Board of Supervisors has considered all the information provided to it.
NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors hereby agrees that the ad -valorem
property tax assigned to OMAD totaling $116,693.39 will be transferred/reassigned to BCMVCD because BCVMCD will
assume responsibility for mosquito abatement services in the territory being annexed to it.
