HomeMy WebLinkAbout20-100RESOLUTION AUTHORIZING IMPANELING OF GRAND JURY FOR 2021 CALENDAR YEAR
WHEREAS, on March 4, 2020, the Governor of the State of California declared a State of Emergency in response
to the outbreak and spread of the novel coronavirus known as COVID-19; and
WHEREAS, the State requires individuals to maintain social distancing of at least six feet to help curb the spread
WHEREAS, the number of confirmed cases of COVID-19 in Butte County continues to rise; and
WHEREAS, on July 14, 2020, the Governor announced an expansion of statewide indoor closures based on the
current public health conditions; and
WHEREAS, pursuant to Art. 1, section 23 of the California Constitution and Penal Code §905, in all counties there
shall be at least one grand jury drawn and impaneled each year; and
WHEREAS, under Penal Code §9�05.5(a), the grand jury shall be impaneled and serve during the fiscal year of the
County; and
WHEREAS,, the term of the 2019/2020 Grand Jury ended on June 30, 2020; and
WHEREAS, COVID-19 remains a clear and present health and safety threat to the residents of Butte County; and
WHEREAS, under Penal Code §905.5(b), the Board of Supervisors may provide that the grand jury shall be
impaneled and serve during the calendar year upon an appropriate transition; and
WHEREAS, such transition may include a grand jury term of no more than 18 months; and
WHEREAS, the Butte County Superior Court and the County of Butte continue to keep the public health and safety
of the residents of Butte County a priority; and
WHEREAS, limiting social contact at this time is one way to curb the spread of COVID-19.
NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors authorizes the imposition of a
transition grand jury for the 2021 calendar year. The term of the transition grand jury shall be from January 1, 2021 to
June 30, 2022, The extended term of the Butte County 2021 Grand Jury is necessary to transition back to a one-year term
for the grand jury which will be impaneled for the 2022/2023 fiscal year.
