HomeMy WebLinkAbout20-120WHEREAS, on October 22, 2019, the Board of Supervisors adopted Ordinance No. 4170 —An Urgency Ordinonce of the County of Butte, Adding Article V, Entitle "Hazard Tree Removal" of Chapter 53, Entitled "Camp Fire Disaster Recovery Ordinance," to Establish Requirements of a Mandatory Hazard Tree Removal Program; and WHEREAS, property owners may comply with the requirements for hazard tree removal by either: 1) submitting a Right -of -Entry permit to enter the Government Tree Program and allowing State contractors to identify and remove trees; or 2) registering to participate in the Private Hazard Tree Removal Program (Private Program) by submitting an Inspection Access Form and then identifying and removing their own hazard trees; and WHEREAS, on October 28, 2019, the County opened enrollment centers allowing property owners to submit enrollment forms in person, by mail, and electronically; and WHEREAS, on March 10, 2020, the Board of Supervisors adopted Ordinance No,. 4181 an Urgency Ordinance amending Chapter 53, Article V to extend the requirements of the mandatory hazard tree removal program to eligible private roads; and WHEREAS, Ordinance No. 4170 and Ordinance No. 4181 were codified in Chapter 53 of the Butte County Code; and WHEREAS, Section 53-86(A) of the County Code requires a visual confirmation of the removal of the hazard trees on the property following the owner's identification and removal of hazard trees in the Private Program; and WHEREAS, 662 property owners enrolled in the Private Program completed the work of removing hazard trees in compliance with County Code; and WHEREAS, 947 property in the Private Program appear to still have hazard trees present; and WHEREAS, County staff contacted all property owners in the Private Program to confirm a visual inspection may be scheduled to confirm hazard trees have been identified and removed; and WHEREAS, the removal of hazard trees threatening public roads and/or rights-of-way of County -maintained roads, eligible private roads, and improved public property is necessary to address numerous risks to, the public peace, health and safety, and to promote the region's recovery from the Camp Fire; and WHEREAS, Section 53-88(B) of the County Code allows the Board of Supervisors to set a deadline for completion of hazard tree removal; and WHEREAS, The Town of Paradise Council adopted a resolution establishing the deadline for completion, of hazard tree removal as December 4, 2020' for properties located in the Town of Paradise; and NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors establishes the deadline to enroll in the Private Program as October 30, 2020 and the deadline for completion, of work (removal of hazard trees), as December 4, 2020.
