HomeMy WebLinkAbout20-131Resolution No. 20-131 RESOLUTION OF THE COUNTY OF BUTTE, BOARD OF SUPERVISORS DELEGATING AUTHORITY TO THE CHIEF ADMINISTRATIVE OFFICER TO DEVELOP AND IMPLEMENT' PROCESSES TO TV4 WHEREAS, omthe evening nfSeptember 8,2O28the catastrophicNorth Complex Fire impacted Butte County and necessitated evacuation orders and warnings for all persons in the affected areas; and WHEREAS, the issuance ofthe immediate widespread evacuation order and evacuation warnings resulted in the establishment ofanEmergency Operations Center, and the closure, mfvarious highways and public facilities inamdarnumd Berry Creek, Feather Falls, Cherokee, Comcovvand the City of{)roYd|e;and WHEREAS, hundreds of County employees and residents were adversely impacted by the North Complex Fire. Some employees lost personal pmnperty, ms, and/or were evacuated from their homes for several days. Some employees were unable to work due to their offices being closed. As a result, some employees were unable to work their normal assigned shifts; and WHEREAS, the North Complex Fire has created complex administrative and personnel issues that are currently being identified, assessed and discussed, and will require, expeditious resolution over the coming weeks in order to maintain the efficient operation ofcounty government; and WHEREAS, the North Complex Fire, which is out of the control of the County aind its employees, has created am unique and dynamic situation; and WHEREAS, the County places the safety of constituents and employees as its main priority; and WHEREAS, while the County (1) is not legally required to pay non-exempt employees for shifts missed due to the disaster (2) is permitted to require exempt employees to utilize vacation or administrative leave for shifts that were mmiosed,itisinthebestinterestoftNeCountythatermp|oVeesm/huvveneprohibitedfronnyervingdur|og the North Complex Fire Incident should not befinancially burdened. NOW, THEREFORE, BE[TRESOLVED: 1. The Butte County Board of Supervisors delegates authority tmthe Chief Administrative Officer, in consultation with the Director ofHuman Resources, tmdevelop, implement and report back tothe Board of Supervisors mnthe processes and payroll rules developed t0compensate employees from September Q,202Othrough September 13, 2020 who were under evacuation, orders where they live or unable to work due to County facilities in OlroviUe being closed for health and safety considerations. 3. |naddition, the Board ofSupervisors delegates authority tothe Chief Administrative Officer, imconsultation with the Director of Human Resources, to develop, implement and report back to the Board of Supervisors on the processes and payroll rules developed to address compensation issues to employees who cmntinued to be impacted bythe evacuation orders amdwarnings after September 13,2Q2Dorlost their homes tothe Fire. The Board of Supervisors finds that there are several public purposes sup,po,rtingth is compensation, including the resolution, of uncertainty surrounding this issue, resolution of potential inconsistency in the treatment of employee commpensation, the continued recruitment and retention of competent and skilled government employees, maintaining the County of Butte's position in the competitive labor market, efficiency of service provision, and the avoidance Vfpotential labor disputes. 4. This resolution shall not be precedent setting.
