Hundreds of County employees and residents were adversely impacted by the North Complex Fire. Some employees lost personal property, possessions, and/or were evacuated from their homes for several days. The North Complex Fire has created complex administrative and personnel issues that are currently being identified, assessed, and discussed. It is in the best interests of the County that employees who were prohibited from working during the North Complex Fire should not be financially burdened. It is requested that the Board of Supervisors adopt a resolution delegating authority to the CAO, in consultation with the Director of Human Resources, to develop, implement, and report back to the Board of Supervisors on the processes and payroll rules developed to: 1) Compensate employees who were unable to work September 9, 2020 through September 13, 2020 due to evacuation orders where they live or employees who were unable to work due to county facilities in Oroville being closed; and 2) Address compensation issues to employees who continued to be impacted by the evacuation orders and warnings after September 13, 2020 or lost their homes due to the fire – action requested – ADOPT RESOLUTION AND AUTHORIZE THE CHAIR TO SIGN. (County Administration and Human Resources) Page 1 4.R EGULAR A GENDA 4.06Introduction and Adoption of an Urgency Ordinance Pertaining to Chapter 53, "Camp Fire Recovery" Extending the Effective Period, Extending the Transitory Period, and the Period for Reconstruction of Legal, Nonconforming Structures – Pursuant to California Constitution Art. XI, section 7 and Government Code sections 25123(d) and 25131, the Department of Development Services proposes the adoption of an Urgency Ordinance pertaining to Butte County Code Chapter 53, "Camp Fire Recovery", as follows: 1) Extending the "effective date" in Sections 53-11, 53-32, and 53-52 from December 31, 2020 to December 31, 2021; 2) Extending the "transitory period" in Sections 53-33 and 53-53 from December 31, 2020 to December 31, 2021; and 3) Extending the period for the reconstruction of a legal nonconforming structure in Sections 53-60 from one year after the fire debris removal is signed off by the County to two years. The urgency ordinance will take effect immediately upon a four-fifths approval of the Board of Supervisors – action requested – 1) WAIVE THE FIRST READING OF THE URGENCY ORDINANCE; AND 2) ADOPT THE URGENCY ORDINANCE OF THE BUTTE COUNTY CODE PERTAINING TO BUTTE COUNTY CODE CHAPTER 53, "CAMP FIRE RECOVERY", AS FOLLOWS: 1) EXTENDING THE "EFFECTIVE DATE" IN SECTIONS 53-11, 53-32, AND 53-52 FROM DECEMBER 31, 2020 TO DECEMBER 31, 2021; 2) EXTENDING THE "TRANSITORY PERIOD" IN SECTION 53-33 AND 53-53 FROM DECEMBER 31, 2020 TO DECEMBER 31, 2021; AND, 3) EXTENDING THE PERIOD FOR THE RECONSTRUCTION OF A LEGAL NONCONFORMING STRUCTURE IN SECTION 53-60 FROM ONE-YEAR AFTER THE FIRE DEBRIS REMOVAL IS SIGNED OFF BY THE COUNTY TO TWO-YEARS, AND AUTHORIZE THE CHAIR TO SIGN (4/5 VOTE REQUIRED). (Development Services) 4.07 Introduction and Adoption of an Urgency Ordinance adding Article III. Emergency Interim Housing Outside the North Complex Fire Area, and Article IV. Emergency Interim Housing Inside the North Complex Fire Area to Chapter 54, entitled, North Complex Fire Recovery of the Butte County Code An urgency ordinance is proposed concerning the North Complex Fire recovery pursuant to California Government Code sections 25123(d) and 25131 and shall take effect immediately upon its approval by at least a four-fifths vote of the Board of Supervisors. The North Complex Fire Recovery Urgency Ordinance Article III. Emergency Interim Housing Outside the North Complex Fire Area, and Article IV. Emergency Interim Housing Inside the North Complex Fire area is proposed for the purposes of temporarily modifying or suspending various Zoning Ordinance Regulations to allow for the fastest possible transition of residents made homeless or displaced by the North Complex Fire to interim and long-term housing The North Complex Fire has created hazardous waste conditions in Butte County, which poses a substantial present or potential hazard to human health and the environment until those properties located inside the North Complex Fire Area are certified clean. The Urgency Ordinance provides relief by providing for the longer-term use and occupancy of recreational vehicles and residential accessory structures and uses, which are ordinarily restricted under the Zoning Ordinance. The Urgency Ordinance also provides relief from County use permit requirements for the relocation of child care and educational facilities damaged by the North Complex Fire to certain zones. The Urgency Ordinance shall remain in effect from the date of adoption until December 31, 2023, unless extended or modified by the Board of Supervisors – action requested – 1) WAIVE THE FIRST READING OF THE URGENCY ORDINANCE ADDING ARTICLE III. EMERGENCY INTERIM HOUSING OUTSIDE THE NORTH COMPLEX FIRE AREA, AND ARTICLE IV. EMERGENCY INTERIM HOUSING INSIDE THE NORTH COMPLEX FIRE AREA CHAPTER 54, ENTITLED, NORTH COMPLEX FIRE RECOVERY OF THE BUTTE COUNTY CODE; AND 2) ADOPT THE URGENCY ORDINANCE AND AUTHORIZE THE CHAIR TO SIGN (4/5 VOTE REQUIRED).
