Good morning,
The Neal Road Recycling and Waste Facility is required every year to document and submit to
CalRecycle that the Landfill has adequate fund balance to properly close the facility at the end of life,
and once closed, to maintain the facility into the future. The attached letter is documentation that
the facility is in full compliance with Title 27 of the California Code of Regulations.
I have also attached the 2020 Financial Assurances Funding Document, that has additional details on
the closure fund balance, remaining permitted capacity, and the insurance documents for the
facility.

Dear Mr. Schmidt,
The California Department of Resources Recycling and Recovery (CalRecycle)
Financial Assurances Unit (FAU)staff has reviewed the 2019-2020landfill capacity
report and fund balance submitted by Butte County for the September 2020fund
anniversary submittal. Financial assurances staff’s review is based on the capacity data,
current fund balance and mostrecently approved cost estimates adjusted for inflation.
At this time, the financial assurances demonstrations meet the requirements identified in
Title 27, California Code of Regulations (CCR), Division 2, Subdivision 1, Chapter 6,
sections 22241 and 22245.
The operator is also required to demonstrate financial responsibility for operating liability
claims. The operator has submitted an acceptable certificate of self-insurance and risk
management as required by section 22251 of the regulations.
Based on the capacity and October 5, 2020fund balance, the facility is adequately
fundedandcurrently meets the requirements of Title 27, CCR, Division 2, Chapter 6,
Subdivision 3, Section 22225. Due to the dynamic nature of financial assurances
demonstrations this information is only valid for 60 days.
