SUBJECT: Lot Line Adjustment (LLA20-0007) for Larry Jendro and Merrily Stover
APNs: 030-170-083, -091 and -092
Project Description and Site Characteristics
Larry Jendro and Merrily Stover are requesting a Lot Line Adjustment to reconfigure three
parcels.

The parcels are zoned Very Low Density Residential (VLDR 1-acre minimum parcel size).
All three parcels are located on Cabana Drive, in the Thermalito area. Parcel 1 is located
at 45 Cabana Drive, Parcel 2 is located at 21 Cabana Drive and Parcel 3 is located at 42
Cabana Drive.
Project Analysis
Each parcel is developed with an existing residence.
Setbacks will be met for all structures.
The project would not result in the creation of any new parcels.
Two of the parcels (030-170-083 and 030-170-091 will be increasing in size. One parcel
(030-170-091) is consistent with the zoning minimum of 1-acre, while the other parcel
(030-170-083) is currently non-conforming, but will be increasing in size by a minor
amount.

The third parcel (030-170-092), which is conforming to the zoning minimum, will be
reduced in size, from 1.36 to 0.62 acres and will become non-conforming to the one-acre
minimum parcel size required by the VLDR zone.
Butte County Zoning Code §24-302.3 allows for exceptions for minimum parcel sizes:
The lot line adjustment would improve health or safety conditions; or improve the design
of the existing affected lots without altering the existing land uses thereon.
The proposed lot line adjustment would qualify for an exception under Section 24-302.3
by allowing for an improved design without altering the existing land uses as supported
by the following:
- The driveway and parking area for APN 030-170-083 is currently on APN 030-170-
092. The lot line adjustment will place the driveway and parking area on the same
parcel as the residence that it serves.
- APN 030-170-092 is located on both sides of the Cabana Drive. The lot line
adjustment will improve safety by allowing each parcel to be on one side of the
Cabana Drive.
- The lot line adjustment will not alter the existing land uses, nor will it allow for the
opportunity for additional land division of any of the resultant parcels.
The parcels are served by Thermalito Water and Sewer District for water and wastewater.
All parcels were created legally.
The Public Works Department, Assessor’s Office, Environmental Health Division and the
Fire Department/CAL-FIRE, were given the opportunity to review this project. None of
these departments objected to the proposed project. Conditions of Approval have been
recommended by Public Works.
18 notices total were mailed to Adjacent Property Owners and Supervisor Bill Connelly’s
office. A public notice was placed in the Chico Enterprise Record and Oroville Mercury
Register newspapers. There were no public comments.
CEQA Issues
This project is exempt from the requirements of the California Environmental Quality Act
(CEQA) under a Section 15305(a) exemption.
ACTIONS FOR CONSIDERATION:
Staff recommends that the Planning Manager take the following action, requiring the
conditions of approval listed in EXHIBIT A:
I. Find that the project is exempt from environmental review under Section 15305(a) of
the California Environmental Quality Act (CEQA). A Class 5 exception consists of
minor alterations in land use limitations in areas with an average slope of less than
20%, which do not result in any changes in land use or density, including but not
limited to minor lot line adjustments, side yard, and set back variances not resulting
in the creation of any new parcel. Because the project is exempt from the provisions

of CEQA, the payment of fees pursuant to Fish and Game Code Section 711.4 and
14 CCR 753.5 is not required.
II. Approve the Lot Line Adjustment for Larry Jendro and Merrily Stover, APNs 030-170-
083, -091 and -092. Project # LLA20-0007, subject to the following Findings and
Conditions of Approval in Exhibit A:
A. The driveway and parking area for APN 030-170-083 is currently on APN 030-
170-092. The lot line adjustment will place the driveway and parking area on the
same parcel as the residence that it serves.
B. APN 030-170-092 is located on both sides of the Cabana Drive. The lot line
adjustment will improve safety by allowing each parcel to be on one side of the
Cabana Drive.
C. The lot line adjustment will not alter the existing land uses, nor will it allow for the
opportunity for additional land division of any of the resultant parcels.
D. The project would not result in the creation of any new parcels.
