State Street, Suite 103 Ukiah, CA 95482 Re: Substantial Conformance Review for River Ranch Subdivision, Tentative Subdivision Map TSM18-0003 (Ashlock – Garden Oak Estates); APNs: 078-090-043 & -044 Dear Ms. Drake: On October 20, 2020, the Butte County Department of Development Services received a request for a substantial conformance review of proposed changes to approved Tentative Subdivision Map (TSM18- 0003 – Garden Oak Estates) and conditions of approval. The proposed changes include the following: 1. Reduction in frontage improvements along Ophir Road (Condition #15/Mitigation Measure #16 & Condition #34) 2. Redesign of interior sidewalks (Condition #35) 3. Replacement of a 6 foot high masonry sound wall with an installation of a landscape berm along Ophir Road (Condition #37) 4. Reconfiguration of 10-inch water main extension (Condition #59) 5. Relocation of the Lincoln Boulevard entrance to the project site further south of the approved location to address site distances and traffic 6. Modification to frontage improvements at the intersection of Lincoln Boulevard and Ophir Road (Condition #34) Butte County Public Works Department reviewed the proposed changes and determined their items above (#’s 1, 2, 3, 5 and 6) are in substantial conformance with the approved map and conditions (letter sent October 19, 2020). South Feather Water and Power Agency reviewed the proposed changes and determined their item above (#4) is in substantial conformance with the approved map and conditions (letter sent October 21, 2020). Lake Oroville Area Public Utility District reviewed the proposed changes and determined they are in substantial conformance with the approved map and conditions (letter send October 21, 2020). Butte County Development Services reviewed the proposed changes. The number of residential lots and commercial area are remaining the same. The change to Condition #34 will make it consistent with Condition #15 (Mitigation Measure #16) regarding frontage improvements along Ophir Road. The replacement of a sound wall (Condition #37) with an landscape berm, will provide equal or better noise attenuation based on the evaluation prepared by Paul Bollard. Based on the above analysis and the substantial conformance determinations by Butte County Public Works, South Feather Water and Power Agency and Lake Oroville Area Public Utility District, Butte County Development Services has determined the proposed changes are in substantial conformance with the approved map and condition of approval.
