Ingeneralterms,theorder providesthat“non-essential”work,movementandgatheringsareprohibitedbetween10:00 PMand5:00AM,incountieswithinthepurpletier. Therehasbeenaconsiderableamountof concernregardingtherestrictionsimposedbythe order,includingwhetherlawenforcementwillbecheckingonhomesorstoppingdriversto ensurecompliance. Inthesechallengingtimes,thereisagreatdealoffear,anxietyanduncertaintywithinthe community.I donotwishtocompoundthoseconcerns bycreatingdistrustandfriction between residentsandlawenforcement. AsbothSheriffandacitizenofButteCounty,thethoughtoflawenforcementofficerspeeking intothe windowsofhomes,orstoppingandquestioningresidentsregardingtheirdestination andfamilyrelationships,merelyforbeingoutsideoftheirhomes, orvisitingthehomeof anotherduringthenighttimehours,allsolelyduetothesuspicionofviolatingthe “Limited StayatHome Order,”isverytroubling. Aspeaceofficers,wemustalways weightherisksandbenefitsofenforcementactionbased onmanyfactors.Thisisespeciallytruegiventheevolvingroleoflawenforcementinour society,alongwithacriminaljusticesystemalreadystrainedbyCOVID-19complications. I amconcernedthenegativeimpactonpublictrust,thehighlikelihoodofescalationandthe strainuponourlimitedlawenforcement resources wouldfaroutweighanybenefitof enforcingsuchanorder. Duetothepotentialinfringementuponconstitutionallyprotectedactivities,alongwiththe lackof feasibilityandpracticalityofenforcingsuchanorder,Iamdirectingmystaff tonot useasuspectedviolationofthenewly-enacted“LimitedStayatHomeOrder”asthebasisfor arrest,citation,detentionorstop. Withthatstated,Iwanttoimplorethemembersofourcommunitytotakepersonal responsibilityfortheirhealthandwell-beinganddoalltheycantohelpprotectthehealthand well-beingofothermembersofourcommunity.Iwanttostresstheimportanceofvoluntarily compliancewith common-sensemeasures,suchassocialdistancing,theuseofface-coverings whereappropriate,propersanitation,stayingathomewhensickandother recommendations aspartofasocialcontractbetweenindividuals,communitygroups, businessesandpublichealthofficials,whichiscriticalinstemmingthespreadofCOVID-19.
