HomeMy WebLinkAbout20-144WHEREAS, in 1964, the State a 11 lowed Education Offices in California either to remain as a County Department under the County Board of Supervisors or to form under a separate Board. The Butte County Office of Education, a public office of education, organized and existing under the laws of the State of California (BCOE) formed under a new Board. Subsequently, BCOE constructed offices at 5 County Center Drive, Orovifle, California, 95965 on the Oroville government campus owned by the County of Butte, a politicali subdivision of the State of California (County); and WHEREAS, in 2017, BCOE expressed that the offices at 5 County Center Drive no longer suits their needs. However, the County expressed both the importance of retaining 5 County Center Drive as it is located upon County property, and the ability to utilize the offices to relocate at least one department that is currently operating in inadequate space; and WHEREAS, the County holds the real property at 655 Oleander Avenue, Chico, California, 95926 whiich, does not meet the needs, of any County department and therefore is surplus. However, BCOE expressed that the 655 Oleander Avenue property does suit their needs; and WHEREAS, the County and BCOE reached an agreement for BCOE to release any real property interests in the Oroville government campus including the improvements known, as 5 County Center Drive via a Quitclaim Deed to the County in exchange for the County providing a long term lease agreement to 655 Oleander Avenue to BCOE; and WHEREAS, California Government Code Section 25365 permits the Board of Supervisors to lease 655 Oleander Avenue to BCOE, a county board of education, upon the terms and conditions as are agreed upon and without complying with any other provisions of this code. NOW, THEREFORE, BE IT RESOLVED that the Butte County Board of Supervisors hereby authorizes the Butte County Director, General Services to execute all necessary documentation in order to effectuate the release of any real property interests in Oroville government campus including the improvements known as 5 County Center Drive, Oroville.
