Washington D.C. 20426 SUBJECT: FOREST SERVICE COMMENTS ON THE POE HIKING TRAIL FEASIBILITY STUDY (ARTICLE 407) POE HYDROELECTRIC PROJECT, FERC NO. 2107 Dear Ms. Bose: The United States Department of Agriculture, Forest Service, Plumas National Forest (PNF) submits the following comments in response to Pacific Gas and Electric Company’s (PG&E) July 30, 2020 filing with the Federal Energy Regulatory Commission (FERC) of the Poe Reach Trail Feasibility Study (“Feasibility Study”) for the Poe Hydroelectric Project (“Project”, FERC No. 2107). PG&E concluded that the need for private property easements, potential impacts to sensitive environmental resources, high costs of construction and maintenance, and low recreational value led them to determine that construction of the Poe Reach Trail is not feasible. However, the Forest Service supports development of one or more of the trail options for the Poe Reach described in the Feasibility Study. We specifically address three of the issues raised by PG&E, in the remainder of this letter: sensitive resource issues on National Forest System (NFS) lands, costs, and public demand for trails. The fourth issue, which relates to private property, is addressed in the FERC’s guidance on recreation development which covers their regulations and orders (FERC 1996). This guidance indicates that land acquisitions (or easements) should considered by licensees in order to “ensure optimum development of the recreational resources afforded by the project” (Appendix C - 18 CFR Section 2.7 Recreation Development at Licensed Projects, FERC 1996). Background The FERC acknowledged the need for all-weather hiking trails and recreational activities in the project area when, in its final Environmental Assessment (“EA”, FERC 2007), it recommended that the Licensee conduct a Feasibility Study on two possible trails: the abandoned trail between the Poe Powerhouse and Bardees Bar (Poe Reach Trail) and an abandoned road for use as a trail on the upriver direction from Bardees Bar (Bardees Bar Trail). Following issuance of a new FERC license in 2018, FERC included License Article 407, which states: Article 407. Hiking Trail Feasibility Study. Within 9 months of license issuance, the licensee must conduct a feasibility study on improving an existing abandoned trail between Bardees Bar and the Poe powerhouse road and compare the results of this study with the information provided in PG&E’s September 2006 feasibility report on modifying Caring for the Land and Serving People Printed on Recycled Paper Ms. Kimberly Bose 2 the abandoned construction road, upstream of Bardees Bar, for use as a trail; and if feasible, based on the results of the study, include in the Recreation Plan a schedule for constructing an all-weather hiking trail in one of the two locations. \[FERC Order Granting Rehearing, April 18, 2019\] PG&E provided the July 2020 letterand feasibility study to satisfy the Article 407 license requirement to conduct a feasibility study on building and maintaining a recreational trail along the Poe Reach of the North Fork Feather River. PG&E also provided a subsequent letter to the FERC (“ANSWER OF PACIFIC GAS AND ELECTRIC COMPANY TO COMMENTS ON COMPLIANCE FILING”) on October 19, 2020 Comments referenced by FERC staff in the final Poe Project EA indicate that an abandoned trail already exists roughly connecting the Bardees Bar Area to the Poe Powerhouse Road (FERC 2007, pages 163-165). These comments described the Forest Service’s interest, indicating that the Forest Service had conducted preliminary mapping of the \[Poe Reach\] Trail as well as of areas of cultural significance, and also made initial outreach to the private landowners. At the time of the EA, the FERC staff analysis indicates support for improving that abandoned trail, rather than the abandoned construction road: “However, as discussed in our analysis of recreational enhancements at Bardee’s Bar, there is a need to develop a trail in this area in order to enhance recreational opportunities in the Feather River canyon and also to divert users away from sensitive resources. Butte County recommends modifying an abandoned construction road to an all-weather casual hiking trail between Bardee’s Bar and an improved scenic point downstream of the State Highway 70 bridge. PG&E and Michael Taylor estimate that converting this road into a trail would be difficult, as well as costly. However, Mr. Taylor describes an alternative abandoned trail in this area that would require both minor modifications and negotiations with private landowners due to its location. We agree that there are several advantages to reopening this trail.” (FERC 2007, page 165) While both potential trails referenced in the Poe Project EA were evaluated in the Feasibility Study, the Bardees Bar Trail was dismissed as being of “high cost, would see low estimated use, and would provide low recreational value”. The Feasibility Study thus focused on the Poe Reach Trail and concluded that while there would be some construction challenges, “… the backdrop is stunning and allows for a valuable recreational trail experience that provides amazing vistas and access to the North Fork of the Feather River. Currently there are a limited number of managed recreational trails in a county where new recreational opportunities can serve as a catalyst for economic growth and improvement in the quality of life for Butte County residents….” The PNF has been collaboratively working with PG&E on various Project resource management and monitoring plans, including the Recreation Plan, since the issuance of PG&E’s new license for this Project in December of 2018. Sections of the Poe Reach Trail(s) cross NFS lands administered by the PNF. The Plumas National Forest Land and Resource Management Plan, as amended (USDA Forest Service 1988 and 2004) provides for a variety of forest-related recreation, and coordinates recreation with other resources through the Recreation Opportunity Spectrum system (USDA Forest Service 1988, Management Direction pg. 4-3). PNF Ms. Kimberly Bose 3 management direction requires improvement and expansion of developed facilities and trails to meet demand while reducing unit costs and protecting other resources (USDA Forest Service 1988, Management Direction pg. 4-3). The Poe Reach Trail will contribute to fulfillment of these requirements by increasing access to recreational activities and scientific monitoring sites; promoting exercise, health and enjoyment of our public lands; and investing in the economic growth of the surrounding rural communities. Specific Comments Sensitive Resource Issues The PNF believes the cultural and biological resource concerns raised by PG&E can be mitigated by adjusting the trail alignment or potentially including elements such as steps or bridges, to create a safe trail. These mitigations may also balance overall costs of construction because such elements may provide for full avoidance of sensitive resources. Specifically, the PNF does not foresee issues with amphibian populations at stream crossings as long as the trail is clearly marked/signed, and construction minimizes disturbance of the stream channel. While we don’t anticipate major issues, the PNF assumes, that as we have done on many other projects implemented on NFS lands, we would work closely with PG&E to avoid or mitigate any potential effects to these sensitive resources. Costs PG&E retained Butte County Resource Conservation District (BCRCD) to conduct the Feasibility Study which included an assessment of feasibility and costs for construction and maintenance of the Poe Hiking Trail. The cost estimates developed by BCRCD are in line with trail construction and maintenance costs for recent Forest Service trail projects. PG&E’s separate overall cost estimates for trail construction were almost four times higher than the BCRCD estimates, and for some line items, PG&E’s cost estimates were over five times higher than BCRCD’s estimates (Attachment 2 to PG&E’s July 30, 2020 filing with the FERC). These higher costs are PG&E’s main opposition to the trail, yet PG&E did not provide a clear explanation or documentation for how these costs were determined. An abandoned trail already exists (described in the FERC’s Final EA referenced above), and redevelopment of this alignment or sections thereof provides a less costly opportunity than would developing a new trail. PG&E indicated that to construct sections of the trail on NFS lands, “…would require meeting the Forest Service’s stringent design standards, which appear incompatible with the proposed route.” While it is true that all trails must be evaluated as to whether they can meet Forest Service trail and accessibility standards, elements of terrain and topography may be used to identify exceptions in some cases. PG&E is aware of this evaluation process as it was recently used in the design of the Poe Beach Trail within the Project area. Cost estimates should have considered this range of options. Finally, two less costly loop trail options were identified in the Feasibility Study to address private landownership issues. If access is ultimately denied for easement through the two private property parcels, the PNF supports the development of these loop trails. These trails would provide public recreation opportunities and access to the river without crossing private lands. Ms. Kimberly Bose 4 Public Demand Themajority of visitors to the PNF are there to participate in recreational activities,and these visits provide substantial economic benefits to the local communities. The Forest Service conducts National Visitor Use Monitoring (NVUM) every five years. The last survey on the PNF was in 2015 and is covered in the attached 2020 report (USDA Forest Service 2020). In their July 2020 letter, PG&E stated that there is “lack of evidence for demand for such a trail”, “the recreational use and value of the trail are low” and “tremendous uncertainty regarding potential use of the proposed hiking trail”. Based on the following information, the PNF respectfully disagrees with those statements. The PNF receives thousands of visits each year. In 2015, visits were estimated at 357,000 overall, including 124,000 visits to day use sites (such as trails) and 108,000 visits to developed overnight sites(page 8, Table 2 in USDA Forest Service 2020). The 2015 surveys documented that “hiking/walking” had the highest participation rate of any recreation activity on the Plumas National Forest, with over 39% of the visitors surveyed participating in hiking/walking as an activity (page 20, Table 13 in USDA Forest Service 2020,). This data demonstrates an extremely strong demand for trail opportunities on the PNF. All-season hiking trails that provide access to fishing and wildlife viewing are asignificant visitor demand. The Poe Reach Trail is located in an area that does not currently have developed hiking opportunities. Most of the trail system on the PNF is above snowline. The Poe Reach Trail is located at an altitude that can be enjoyed year-round, providing access to the North Fork Feather River canyon and opportunities to participate in a variety of outdoor activities. For example, the trail would also provide opportunities for two activities in which PNF visitors frequently participated (fishing - 25.3% of visitors and wildlife viewing - 22.5% of visitors; USDA Forest Service 2020). In 2015, visitors to the PNF were a combination of local (53% of visitors live within 50 miles) and remote (47% live 50 to over 500 miles away) travelers. Most visitors (62%) to the PNF made one to five visits per year, while a few (8%) were very frequent visitors. More than 58% of the visits to the Plumas NF were day trips away from home, rather than overnight trips from home, though visitors who stayed overnight, typically stayed for three days (USDA Forest Service 2020). There areseveral developed campgrounds in theNorth Fork Feather River Canyon of the PNF, within a one-hour drive of the Poe Project area, providing opportunities for visits to local day use sites along the river, including the Poe Reach Trail. Overall, the PNF believes that construction of one of the Poe Reach Trail options will fulfill the requirements in Article 407 of the Licensee and address public recreation demand for hiking trails on the PNF and in Butte County. The Feasibility Study provides several trail options, and a process is available to determine exceptions to Forest Service standards due to terrain, addressing cost-effectiveness of this trail. The access to recreational opportunities that will result from this trail are consistent with PNF Forest Plan direction and are expected to provide a substantial benefit to the public.
