A height review for a proposed 90-foot tall communication facility (mono pine
stealth tower) on APN 047-600-007, 4338 Shorthorn Drive – 5.65 acres. The
parcel is located within Compatibility Zone C of the Chico Municipal Airport.
The parcel is located on the north side of Shorthorn Drive, approximately 600 feet
east of Hereford Drive, north and west of the City of Chico.
SUMMARY:
Staff presented the consistency review of the proposed communication facility, 90-foot stealth
tower, to the Butte County Airport Land Use Commission on October 21, 2020. The Commission
requested staff bring back information to determine if the proposed tower would be a hazard to
flights in and out of Chico Municipal Airport and to Enloe Flight Care.
ANALYSIS:
The applicant provided an FAA Aeronautical Study that determined the proposed
communication facility would not create a hazard to air navigation. The study also identified
that marking and lighting are not necessary for aviation safety. If marking/lighting are done,
the FAA recommends it be done in accordance with FAA Advisory circular 70/7460-1 L
Change 2.
Staff spoke with Enloe Flight Care regarding potential hazards to their operations. They
identified they height and location of the communication facility would not create hazards to
their flight care operations. They also mentioned that lighting is not necessary based on the
height of the facility.

RECOMMENDATION:
Based on the additional information, staff recommends that the Butte County Airport Land Use
Commission find ALUC File No. A20-0003 (William Lewis) consistent with the height review
requirements of the 2017 Airport Land Use Compatibility Plan for the Chico Municipal Airport
and no lighting is required.

CONSISTENCY FINDINGS FOR:
ALUC File No. ALUC20-0003 (William Lewis)
The Airport Land Use Commission (ALUC) has prepared the following findings based on data
contained in the 2017 Airport Land Use Compatibility Plan (ALUCP) for the Chico Municipal
Airport, as well as site specific information submitted by the applicant and ALUC staff.
The following findings have been prepared at the direction of the ALUC and are for the
consideration of the Lead Agency (Butte County) when making a decision on the project.
SECTION 1: ENVIRONMENTAL FINDINGS
A.No environmental documentation has been completed for this project by ALUC
staff. Butte County will determine the environmental Review for the proposed Use
Permit.
SECTION 2: CONSISTENCY FINDING FOR PROPOSED PROJECT
A.The communication facility will not attract birds or other hazardous wildlife to the
airport area.
B.The proposed communication facility will not create visual hazards, such as light,
sources of glare, and sources of dust, stream or smoke. The project will generate
very little land disturbance or light. No steam or smoke will be generated by the
communication facility.
C.The FAA determined, per Aeronautical Study No. 2020-AWP-5478-OE that the
proposed communication facility would not create a hazard to air navigation.
D.Enloe Flight Care determined that based on the height and location of the
communication facility that it would not create a hazard for their flight care
operations.
E.The project site elevation is 220 feet above sea level. Per BCAUCP Exhibit CIC-
4.1B Airspace Protection Surfaces Map, based on FAA Part 77, the Airspace
Protection Area starts at 390 feet above sea level. With the height of the
communication facility (90 feet), the highest point would be 290 feet about sea
level. This would be 100 feet below the Airspace Protection Area.
F.The project site is located in is located in the Traffic Pattern Zone, which is outside
the Runway Protection Zone, Inner Approach/Departure Zone, Inner Turning Zone,
Outer Approach/Departure Zone and Sideline Zone.

The Federal Aviation Administration has conducted an aeronautical study under the provisions of 49 U.S.C.,
Section 44718 and if applicable Title 14 of the Code of Federal Regulations, part 77, concerning:

This aeronautical study revealed that the structure does not exceed obstruction standards and would not be a
hazard to air navigation provided the following condition(s), if any, is(are) met:
It is required that FAA Form 7460-2, Notice of Actual Construction or Alteration, be e-filed any time the
project is abandoned or:
_____ At least 10 days prior to start of construction (7460-2, Part 1)
__X__ Within 5 days after the construction reaches its greatest height (7460-2, Part 2)
Based on this evaluation, marking and lighting are not necessary for aviation safety. However, if marking/
lighting are accomplished on a voluntary basis, we recommend it be installed in accordance with FAA Advisory
circular 70/7460-1 L Change 2.
This determination expires on 11/22/2021 unless:
(a) the construction is started (not necessarily completed) and FAA Form 7460-2, Notice of Actual
Construction or Alteration, is received by this office.
(b) extended, revised, or terminated by the issuing office.
(c) the construction is subject to the licensing authority of the Federal Communications Commission
(FCC) and an application for a construction permit has been filed, as required by the FCC, within
6 months of the date of this determination. In such case, the determination expires on the date
prescribed by the FCC for completion of construction, or the date the FCC denies the application.

This determination is based, in part, on the foregoing description which includes specific coordinates, heights,
frequency(ies) and power. Any changes in coordinates, heights, and frequencies or use of greater power, except
those frequencies specified in the Colo Void Clause Coalition; Antenna System Co-Location; Voluntary Best
Practices, effective 21 Nov 2007, will void this determination. Any future construction or alteration, including
increase to heights, power, or the addition of other transmitters, requires separate notice to the FAA.This
determination includes all previously filed frequencies and power for this structure.
If construction or alteration is dismantled or destroyed, you must submit notice to the FAA within 5 days after
the construction or alteration is dismantled or destroyed.
This determination does include temporary construction equipment such as cranes, derricks, etc., which may be
used during actual construction of the structure. However, this equipment shall not exceed the overall heights as
indicated above. Equipment which has a height greater than the studied structure requires separate notice to the
FAA.
This determination concerns the effect of this structure on the safe and efficient use of navigable airspace
by aircraft and does not relieve the sponsor of compliance responsibilities relating to any law, ordinance, or
regulation of any Federal, State, or local government body.
A copy of this determination will be forwarded to the Federal Communications Commission (FCC) because the
structure is subject to their licensing authority.

BACKGROUND:
The project site is approximately 5.65 acres.
The parcel is developed with a single-family dwelling
The property is located in the unincorporated area of the County, north and west of the City of
Chico. It is zoned VLDR /SR-1 (NCSP)/AOC (Very Low Density Residential/Suburban
Residential 1-acre minimum (North Chico Specific Plan)/Airport Overlay C and has a General
Plan Land Use Designation of VLDR (Very Low Density Residential).
The proposed project is a 90-foot tall communication facility (faux tree) and ground related
equipment located in a 625 square foot leased area (25’ x 25’).
ANALYSIS:
APN 047-600-007 is located within the C Compatibility Zone.

The project site area is approximately 10,160 feet northwest of runway 13L – 31R for the Chico
Municipal Airport and is located approximately 5,300 feet west of the extended runway
centerline.
The project site area is approximately 11,400 feet northwest of runway 13R – 31L for the Chico
Municipal Airport and is located approximately 4,600 feet west of the extended runway
centerline.
The C Compatibility Zone requires height review for objects greater than 70 feet.
The Butte County Airport Land Use Compatibility Plan (BCALUCP) identities Airspace
Protection Policies to address structures that exceed the height maximum per the Compatibility
Zone.
Policy Objective – Airspace protection compatibility policies seek to prevent creation of land
use features that can pose hazards to the airspace required by aircraft in flight and have the
potential for causing aircraft accident.
Measures of Hazardous to Airspace –
Physical hazards include tall structures that have the potential to intrude upon protected
airspace as well as land use features that have the potential to attract birds or other
potentially hazardous wildlife to the airport area.
Visual hazards include certain types of lights, sources of glare, and sources of dust, steam
or smoke,
Electronic hazards are ones that may cause interference with aircraft communications.
The project site is located at approximately 200 feet above sea level. While the existing
runways are approximately 225 and 230 feet above sea level.
The proposed communication facility exceeds Compatibility Zone C height of 70 feet by 20
feet.
The communication facility will not attract birds or other hazardous wildlife to the airport area.
The proposed communication facility will not create visual hazards, such as light, sources of
glare, and sources of dust, stream or smoke. The project will generate very little land
disturbance or light. No steam or smoke will be generated by the communication facility.
BCALUCP Section 3.5.1 - Evaluating Airspace Protection/Object Height Compatibility for
New Development:
(a) The policies of this Section, together with the Airspace Protection Surfaces Map drawn in
accordance with FAR Part 77, Subpart C and reflecting the runway length, runway end
locations, and approach type for each end of the runways as identified on Map CIC-4.1B
for the Chico Municipal Airport
(c) The Critical Airspace Protection Zone consists of the FAR Part 77 primary surface and the
area beneath portions of the approach and transitional surfaces to where these surfaces
intersect with the horizontal surface together with the Height Review Overlay Zone.
(d) The Height Review Overlay Zone encompasses locations where the ground elevation

exceeds or is within 35 feet beneath the Airspace Protection Surface as defined by FAR
Part 77 for the airport.
BCALUCP Section 3.5.2 – Object Height Criteria – The criterial for determining the
acceptability of a Project with the respect height are as follows:
(a) Except as provided in Paragraphs (b) and (c) of this policy, no object, including mobile
object as a vehicle or temporary object such as a construction crane, shall have a height
that would result in a penetration of an Airspace Protection Surface. Any object that
penetrates one of these surfaces is, by FAA definition, deemed an obstruction.
(e) The Critical Airspace Protection Zone consists of the FAR Part 77 primary surface and the
area beneath portions of the approach and transitional surfaces to where these surfaces
intersect with the horizontal surface together with the Height Review Overlay Zone.
(f) The Height Review Overlay Zone encompasses locations where the ground elevation
exceeds or is within 35 feet beneath the Airspace Protection Surface as defined by FAR
Part 77 for the airport.
The project site elevation is 200 feet above sea level. Per BCAUCP Exhibit CIC-4.1B Airspace
Protection Surfaces Map, based on FAA Part 77, the Airspace Protection Area starts at 390
feet above sea level. With the height of the communication facility (90 feet), the highest point
would be 290 feet about sea level. This would be 100 feet below the Airspace Protection Area.
