Dear Jose Bayardo:
Butte County Planning recently received an application for wall and fence height
increase recently for the property (APN: 026-111-011) at 1908 Baldwin Ave in Palermo,
project #ADM21-0006. Pursuant to Butte County Code Chapter 24-60 A. 1. we find that
the fencing material as being used currently is not permitted; in addition, the maximum
fence height is 5.5 feet within the front and street side setbacks – with Public Works line
of sight clearance, and up to 8 feet elsewhere.
If you would like to submit elevation drawings of any proposed fence, noting materials
used (in compliance with the code) and heights, and a site plan showing the location of
the fence sections relative to his property lines, we can approve ADM21-0006.
The approved fencing materials for your Urban Low Density Residential (LDR) zoned
property include: decorative masonry, ornamental iron or steel, or wood. Your current
fence does not fall under the ornamental iron or steel category. Fence materials should
be purchased as designated fencing materials, not other material types, like corrugated
metal, which is in fact strictly prohibited.
Please refer to the attached code section (Article 13. of Butte County Code Chapter 24)
for more information.
If you have any questions please let me know, I can be reached at 530.552.3685 or
