Project Description and Site Characteristics
Anthony G. and Renette R. Symmes are requesting a Lot Line Adjustment to reconfigure two
parcels.

The parcels are zoned Very Low Density Residential (VLDR 1-acre minimum parcel size).
Both parcels are located on the south side of Durham-Dayton Highway, east of Durham.
Parcel A is located at 2125 Durham-Dayton Highway. Parcel B is located at 2123 Durham-
Dayton Highway.
Parcel A fronts on Durham-Dayton Highway, while Parcel B accesses Durham-Dayton
Highway by a private easement.

Project Analysis
Each parcel is developed with an existing residence.
Setbacks will be met for all existing structures.
The project would not result in the creation of any new parcels.
The existing parcel sizes are consistent with the zoning parcel size minimum (1-acre).
The resultant parcel sizes (5.814 and 1.287) will be consistent with the zoning parcel size
minimum (1-acre).
The parcels are served by individual wells and wastewater systems.
The parcels were created legally.
The Public Works Department, Assessor’s Office, Environmental Health Division and the Fire
Department/CAL-FIRE, were given the opportunity to review this project. None of these
departments objected to the proposed project. Conditions of Approval have been
recommended by Public Works.
20 notices total were mailed to Adjacent Property Owners. A public notice was placed in the
Chico Enterprise Record and Oroville Mercury Register newspapers. There were no public
comments.
CEQA Issues
This project is exempt from the requirements of the California Environmental Quality Act (CEQA)
under a Section 15305(a) exemption.
ACTIONS FOR CONSIDERATION:
Staff recommends that the Planning Manager take the following action, requiring the conditions
of approval listed in EXHIBIT A:
I. Find that the project is exempt from environmental review under Section 15305(a) of the
California Environmental Quality Act (CEQA). A Class 5 exception consists of minor
alterations in land use limitations in areas with an average slope of less than 20%, which
do not result in any changes in land use or density, including but not limited to minor lot
line adjustments, side yard, and set back variances not resulting in the creation of any
new parcel. Because the project is exempt from the provisions of CEQA, the payment of
fees pursuant to Fish and Game Code Section 711.4 and 14 CCR 753.5 is not required.
II. Approve the Lot Line Adjustment for Anthony G. and Renette R. Symmes Family Trust,
APNs 040-200-096 and -097. Project # LLA20-0011, subject to the following Findings and
Conditions of Approval in Exhibit A:
A. The resultant parcel sizes are consistent minimum parcel size (1-acre) of the Very Low
Density (VLDR) zone.
B. Both parcels will have sufficient area for wastewater (septic tank and leach field) area.
C. The lot line adjustment will not alter the existing land uses.
D. The project would not result in the creation of any new parcels.
