Good morning Board members,
Recent state legislation, SB 95 requires public agencies to provide 80 hours of Covid-19
Supplemental Paid Sick Leave to all employees retroactive to January 1, 2021, effective through
September 30, 2021. As you recall, back in March 2020 your Board generously provided 80 hours of
leave to employees, to be used through December 2020. Subsequently, the Board extended the
time to use those hours through March 31, 2021.
The 80 hours provided by the Board, and the 80 hours required by SB 95 work in conjunction with
each other. Any hours used during period of January 1, 2021-March 31, 2021 of the County-provided
leave will count towards the new 80 hours required by SB 95.
For example, if an employee used 30 hours of the County-provided leave during January 2021 –
March 31, 2021 they would still be eligible for 50 hours of the SB 95 leave. Also, the American
Rescue Plan can cover the costs of this leave.
Additionally, the American Rescue Plan also outlines provisions of more voluntary federal Emergency
Paid Sick Leave and Emergency FMLA. I will bring details for a discussion to the Board soon.
