The Pacific Gas and Electric Company (PG&E) consults on behalf of the Federal Energy Regulatory Commission (FERC) pursuant to Section 106 of the National Historic Preservation Act of 1966 (54 U.S.C. § 300101), as amended, and its implementing regulation found at 36 CFR 800. By letter dated February 22, 2021 (included with your submittal), the Army Corps of Engineers, also responsible for issuing a permit for the project, has designated the FERC as the lead federal agency responsible for consultation under Section 106. The project includes demolition and removal of the Haskins Valley Boat Ramp on Bucks Lake, construction of a concrete mat replacement boat ramp, and construction of new pavement on the access road, turnaround, and parking areas. Rock slope protection will be added along the road and boat ramp at the water’s edge. Additional activities include minor vegetation clearing and grubbing, drainage improvements (new concrete swale, replacement of culvert and headwall, new rock-lined ditch), parking lot paving, and dewatering of the construction area. The Area of Potential Effects (APE), depicted in Attachment 3, includes the project area to a depth of six feet as well as an off-site staging area for which no improvements are necessary and no ground disturbance is anticipated. Historic property identification efforts included a records search of the APE; previous pedestrian survey performed during the 2015 relicensing of the Bucks Creek Hydroelectric Project was relied on to Ms. Kathleen ForrestFERC_2021_0323_001 April 15, 2021 Page 2of 2 inform on thepresence of additional resources. Present within the APE is the National Register of Historic Places (NRHP) eligibleBucks Creek Hydroelectric Historic District (Criteria A and C), for which the Bucks Lake Dam is a contributor and Bucks Lake itself is a character-defining feature. Consultation with Native American Indian Tribes has been ongoing in support of the relicensing for the Bucks Creek Hydroelectric Project. No significant places have been identified in the APE thus far and no additional consultation was initiated for this undertaking. PG&E applied the criteria of adverse effect at 36 CFR § 800.5(a)(1) and determined that the undertaking will not adversely affect Bucks Lake, Bucks Lake Dam, or the Bucks Creek Hydroelectric Historic District and the project activities are consistent with the Secretary of the Interior’s Standards for the Treatment of Historic Properties, specifically the Standards for Rehabilitation. Currently PG&E is seeking SHPO comments on the following: The appropriateness of the Area of Potential Effects (APE) pursuant to 36 CFR § 800.4(a)(1); The adequacy of historic property identification efforts in accordance with 36 CFR § 800.4(b); The finding of no adverse effects pursuant to 36 CFR § 800.5(b) Following review of your submittal, I offer the following comments: Pursuant to 36 CFR § 800.4(a)(1), I find the APE as defined to be appropriately defined; Pursuant to 36 CFR § 800.4(b), I find the efforts to identify historic properties to be reasonable and in good faith; Pursuant to 36 CFR § 800.5(b) I do not object to a finding of no adverse effects; If you have any questions or concerns, please contact Associate State Archaeologist Brendon Greenaway at Brendon.Greenaway@parks.ca.gov.
