Please review this information. This past Tuesday, the Butte County Board of Supervisors had a hearing and sent a letter to the Board of Forestry on their Proposed Minimum Fire Safe Regulations 2021 (see attached staff report). The regulations propose to prohibit building, re- building in some of the fire zones, housing additions and certain property transfer transactions in portions of the Unincorporated Area of CALIFORNIA where there is high fire severity (see attached map). Given the housing crisis that is already in full swing, this would cause a lot of heartburn to the already impacted process. The effects of these regulations for the Department of Forestry, if it passes, will be far reaching. The county sent a letter outlining their concerns to the Board of Forestry earlier this week. The Board of Forestry asserts that they are not hearing from the public on the proposed regulations, which seems to indicate that they haven't heard from enough people....yet. There is a public comment period on the proposed regulations, however, it closes this coming Tuesday, June 15th. To help expedite the comment process, Marisa has written a sample letter that you can use, or you can write your own. The fastest way to provide a comment is to send via email to PublicComments@BOF.ca.gov, as only written comments will be accepted. I also included another very indepth letter with summary of the impacts of these regulations written by Peg Moak to the BOF which lays it all out. I have participated in virtual meetings hosted by the Board of Forestry (BOF) over the past several months, as an interested landowner, a member of Butte County’s Forest Advisory, Federal/State Land Use Coordinatingand Wildfire Safety Task Force Committees, and a member of the 2018 Camp Fire Recovery Housing Committee. I appreciate the opportunity to comment, and understand that the Board is attempting these regulatory changes with an eye to public safety; however, I strongly believe they are neither practical nor in the best interests of the public. The regulations as proposed cause a high degree of concern, for the following reasons: The standards are so rigid and unaffordable to implement that property owners will not be able to legally construct dwellings as they have planned. The inability to build will sharply decrease land values. In effect, I believe this effectively constitutes a taking of their land. The result will likely be a combination of unpermitted structures being built and, at the other end of the spectrum, abandonment of properties. The property maintenance needed for wildfire safety will highly likely be abandoned, as well. Lack of land maintenance will exacerbate the wildfire danger to the remaining population. Only wealthy property owners will be able to afford to upgrade driveways and roads from their structure to a collector road, and construct bridges that meet public standards. This creates an equity issue in a state where affordable housing is already a desperately critical situation, surely conflicts with the State direction to encourage affordable housing, and certainly creates a huge issue here in Butte County. Additionally, the road standards, if fully implemented, would require widening of many roads where no easement across private property exists to support such improvements. This one-size fits all regulation is overly restrictive, burdensome and detrimental to the welfare of California’s citizens. They fail to recognize the importance of local control and good judgement of the local agencies charged with developing building standards with an eye to public safety given their unique terrain, road systems and the needs of their citizens. The road standards, applicable even to personal driveways, are far too stringent, unaffordable for most rural public entities to accomplish stated upgrades, and certainly unaffordable for property owners who wish to build – or, as written, even add a room to their home, or expand a living area. Although exemptions apply for wildfire rebuilds, that limited exemption is not sufficient to encompass all legitimate building scenarios for individuals living in the VHFHSZ, i.e. what if a home needs to be rebuilt because of an independent structure fire? What if it is damaged by an earthquake? Many of the setback and other requirements cannot be met for rebuilds, due to lot size or configuration – again, this makes rebuilding impossible, as written. Local Building officials should be able to evaluate and make discretionary decisions in their jurisdictions. What if the property owner decides to sell their wildfire damaged parcel to a willing buyer, who now cannot build under a wildfire rebuild exemption? What if the current owner simply wants to make their home more spacious, or upgrade the construction or change the location of the home on their property? The regulations preclude all of these reasonable scenarios, and many more. Why would expanding the footprint of an existing home trigger the regulations? It’s not increasing the number of people in the home, just the space it occupies – this makes no sense at all. The change to the parcel split provisions is unnecessary – it has been 4 or more for a very long time – what purpose does it serve to change it to 3 parcels, and ditto for a lot line adjustment? Property owners have made plans, sometimes estate plans, hinged on this long time standard – this is another example of a taking of property. There will be a revenue consequence to the local taxing agencies – property taxes will decline, permit fees will go uncollected, development – for which there are already reasonable fire- hardening standards – will decline drastically, meaning many of the fire devastated communities will not be able to recover to the extent necessary to support local agency services, schools, parks, medical services, etc. In closing, I hope that you take a hard look at the points of concern brought up, not just by me, but by many county representatives I listened to during the meetings, and by organizations such as RCRC, who represents the interests of rural counties statewide. We must “beware of the rule of unintended consequences.” I believe that the use of other measures, such as grant or tax credit initiatives to fire-harden homes, utilization of fire resistant exterior construction techniques, enforcement of defensible space requirements, and fuels reduction along roadways, will be far more effective in improving public safety during wildfire events than these proposed regulations will engender. The proposed regulations would severely inhibit the building, re- building, expansion, and property transactions processes for residents living in high fire severity zones within the unincorporated county. We have seen unprecedented demand for housing, specifically affordable housing, and the proposed regulations place significant burdens on the building industry and the ability to meet demand. In fact, this may force people to circumvent the permitting process and build structures illegally, which places undue burdens on the county to enforce and potentially endangers their neighbors. The regulations are particularly onerous for those who live in counties, such as Butte, which have experienced an unprecedented loss of housing due to catastrophic fires. I urge you to consider these comments and make changes to the proposed regulations to be more inclusive of concerns raised by local government agencies and the public. Sincerely,
