Proclamation on November 12, 2018, the November 2018 California Wildfires Disaster, FEMA 4407-DR-CA, was declared by the Federal Emergency Management Agency (FEMA), a Presidential Major Disaster Declaration and included Butte County. Per Title 44 of the Code of Federal Regulations § 206.222(a)(b)(c) for Applicant Eligibility, only state and local governments, certain private non-profit institutions, and tribal organizations are eligible applicants for Public Assistance. However, since the Miocene Canal is private property owned by Pacific Gas & Electric Company (PG&E), it is not eligible for Federal or State Public Assistance. As mentioned in your letter, PG&E agreed to assist in the rebuild of the Miocene Canal. In addition, during the PG&E Plea Agreements, PG&E assumed responsibility for the Camp Fire (June 2020) and thus, agreed to provide up to 15-million dollars over the next five years to formulate a course of action to secure water back into the Miocene Canal.
