Please exercise judgment before opening .. attachments, clicking on links, or replying. Good Morning- Before this email is rebuffed as "out of your control" as I have seen supervisor Conelly respond-I ask you all to carefully consider the following; If you read the current guidance by the Department of Public Health, face masks are required for unvaccinated individuals and for those who are vaccinated when they are 1) on public transit, 2) in public schools, 3) in health care facilities, 4) in correctional facilities, and 5) homeless shelters. (See https://www.cdph.ca.gov/Programs/CID/DCDC/Pages/COVID- 19/guidance-for-face-coverings.aspx) However, on June 11, 2021, Gavin Newsom signed an executive order rescinding Executive Order N-33-20 and N-60-20 which required the people of California to heed/obey the public health orders. (See https://www.gov.ca.gov/wp- content/uploads/2021/06/6.11.21-EO-N-07-21-signed.pdf). Since these Executive Orders have been rescinded, that means that the public health officers only have the powers that the legislature has given to them. I do not see anything in the California Public Health Code that would give a public health official the authority to mandate anyone who is healthy wear a mask (vaccinated or unvacccinated). I know you have to wear a mask on a plane because the current president is refusing to follow the science. However, other than the current regulations on airports, I honestly would like to know what authority any public health officer has to mandate behavior associated with COVID-19. Absent some sort of legal authority, all the public health officers can do is make recommendations which means Californians are free to decide whether or not to follow the recommendations. I went a step further for you all, AB262-"by all means necessary" would not even hold up to the test because no one has PROVEN any of this was NECESSARY so it is a direct violation of the law and anything after rescinding/expiration of emergency orders has merely been a RECOMMENDATION- that is why we as a community are asking you to consider the following attachments as many other counties in the state have and regain local control.
