Encourage your elected representatives to read this resolution and adopt this Resolution:Prohibiting Any Entity From Establishing a Vaccine Requirement or Proof of Vaccine Requirement to Enjoy Any Benefit or Exercise Any Right By Residents of Butte County BeforetheBoardofSupervisorsCountyofButte, StateofCalifornia Inthematterof: RESOLUTIONNO.2021-XX AresolutionoftheButteCountyBoardofSupervisorsprohibitingany entityfromestablishingavaccinerequirementorproofofvaccine requirementtoenjoyanybenefitorexerciseanyrightbyresidentsof ButteCounty. WHEREAS,ButteCountyisasubdivisionoftheStateofCalifornia,and maymakelawstopreservethepublichealth,safetyandwelfareofthose intheCounty;and WHEREAS,TheBoardofSupervisorsfindsthatButteCounty recognizestherightofitsresidentstomakemedicaldecisionsfor themselvesandtheirminorchildren,inaccordancewiththeirpersonal and/orreligiousbeliefs;and WHEREAS,ButteCountyBoardofSupervisorsrecognizesevery patient’srighttorefusemedicaltreatmentandtherighttoretainhisorher privacyconcerningtheirmedicalcare;and WHEREAS,boththeUnitedStatesConstitutionandtheConstitutionof theStateofCaliforniaprohibitinfringementonprivacy,religiousliberty, andunlawfulsearchesandseizures. NOWTHEREFOREBEITRESOLVED,bytheBoardofSupervisors, CountyofButte,StateofCalifornia,thatnoentityshallestablisha vaccinerequirementorproofofvaccinerequirementtoenjoyanybenefit orexerciseanyrightheldbycitizensofButteCounty. BEITFURTHERRESOLVED,bytheBoardofSupervisors,Countyof Butte,StateofCalifornia,thatinresponsetothisresolution,thefollowing shalltakeeffectimmediately: I.CaliforniaHealthandSafetyCode120175.5shallneverbeinterpreted toa)permitthePublicHealthOfficertoremovecitizensofButteCounty fromtheirresidencesunderanycircumstanceunlessthatcitizen’s primarycarephysicianoraphysicianoftheirownselectiondetermines thatsaidresidentiscurrentlyinfectedwithacommunicablediseasethat posesasignificantthreattothecommunity;andb)thatinanycaseall residents mustbeaffordedalldueprocessrightsunderthelawsregardlessofany declaredstateofemergency; II.Thatnobusiness,entity,school,orcountyorcitydepartmentinthe Countyshallrequireanypersontoreceiveavaccination,orberequiredto showproofofavaccination,asaconditionofemployment,education,or toreceiveservice; III.Thatnobusiness,entity,ororganizationintheCountyshallrequire anypersontodonafacialcoveringinordertoenteraplaceofbusinessor tobeservedatthesame; IV.Thatindividualshavearighttoandareencouragedtomakemedical decisionswiththeirowninformedconsent,inconcertwiththemedical providerofhisorherchoosing,andhavetherighttomaintaintheir privacyregardingsaiddecisions,andnobusiness,entity,ororganization shallinterferewiththeserightsinanyway; V.Thatnowastewaterepidemiologysurveillanceorgenetictestingshall beallowedtotakeplacethatviolatestheconstitutionallyprotectedrights ofcitizensagainstinvasionoftheirprivacyortheirrighttobefreefrom searchesorseizureswithoutawarrantorcourtorder. BEITFURTHERRESOLVED,bytheBoardofSupervisors,Countyof Butte,StateofCalifornia,thatinresponsetothisdeclaration,the followingshalltakeeffectimmediately: I.TheCountyshallissuenomaskorfacecoveringmandate,norshallit enforceorallowtobeenforcedanymaskorfacecoveringmandates issuedbyoutsideagency; II.Allsignagerequiringmasksorfacecoveringsshallberemovedfrom allCountypropertyandfacilities; II.AllresidentswithintheCounty,aswellasCountyemployees,are empoweredtomaketheirowndecisionsregardingwhetherornottowear afacecovering,andtheCountyshallnotinanywayinterferewithor overridetheirindividualdecision; IV.TheCountyshallnottreatanypersonsintheCountydifferently basedontheirvaccinationstatus; V.TheCountyshallrequireallmedicalprovidersoperatingwithinthe Countytotakeallstepsnecessarytoprovidetotheirpatientsinformation pursuanttoanyEmergencyUseAuthorizationinregardstovaccinesor othermedicationssothattheirpatientsmaymakeinformedmedical decisionsabouttheirhealthcare. VI.TheCountyshallcausetobemadepublicandnotoriousthis Resolutiontoallinhabitantsandbusinesswithinthecountybywhatever meansaswilleffectuateitsnotice; BEITFURTHERRESOLVED,bytheBoardofSupervisors,Countyof Butte,StateofCalifornia,thatinanefforttoalleviatetheeconomic damageresultingfromenforcementoftheGovernor’s“emergency orders,”theCountyshallestablishan“EconomicReliefFund”forsmall andmedium-sizedbusinessesthathaveincurredexpensesorlostrevenue duetotheGovernor’semergencydirectivesintheformoffines, penalties,legalfees.ThefundshallbecreatedfromtheCounty’sGeneral Fundorfromany“COVIDReliefFunds”receivedbytheCountyfrom thefederalgovernmentinanamountthatiscalculatedtocoverasmany claimsascanbeexpectedtobefiledandshallbedisbursedonafirst come,firstservedbasisbytheBoardofSupervisors.Thoseseeking reimbursementfromtheFundshallsubmitproofoftheirexpensestothe ButteCountyClerkoftheBoardwho,inturn,willplaceanactionitem fortheproposedreimbursementontheagendaofthenextregularmeeting oftheBoardofSupervisors.TheBoardofSupervisorsshallretainunto itselfthesolediscretiontoawardreimbursementsbaseduponfacts presentedtoitbyeachapplicant.
