BeforetheBoardofSupervisorsCountyofButte, StateofCalifornia Inthematterof: RESOLUTIONNO.2021-XX AresolutionoftheButteCountyBoardofSupervisorsprohibitinganyentity fromestablishingavaccinerequirementorproofofvaccinerequirementto enjoyanybenefitorexerciseanyrightbyresidentsofButteCounty. WHEREAS,ButteCountyisasubdivisionoftheStateofCalifornia,andmay makelawstopreservethepublichealth,safetyandwelfareofthoseinthe County;and WHEREAS,TheBoardofSupervisorsfindsthatButteCountyrecognizesthe rightofitsresidentstomakemedicaldecisionsforthemselvesandtheirminor children,inaccordancewiththeirpersonaland/orreligiousbeliefs;and WHEREAS,ButteCountyBoardofSupervisorsrecognizeseverypatient’s righttorefusemedicaltreatmentandtherighttoretainhisorherprivacy concerningtheirmedicalcare;and WHEREAS,boththeUnitedStatesConstitutionandtheConstitutionofthe StateofCaliforniaprohibitinfringementonprivacy,religiousliberty,and unlawfulsearchesandseizures. NOWTHEREFOREBEITRESOLVED,bytheBoardofSupervisors,County ofButte,StateofCalifornia,thatnoentityshallestablishavaccinerequirement orproofofvaccinerequirementtoenjoyanybenefitorexerciseanyrightheld bycitizensofButteCounty. BEITFURTHERRESOLVED,bytheBoardofSupervisors,CountyofButte, StateofCalifornia,thatinresponsetothisresolution,thefollowingshalltake effectimmediately: I.CaliforniaHealthandSafetyCode120175.5shallneverbeinterpretedtoa) permitthePublicHealthOfficertoremovecitizensofButteCountyfromtheir residencesunderanycircumstanceunlessthatcitizen’sprimarycarephysician oraphysicianoftheirownselectiondeterminesthatsaidresidentiscurrently infectedwithacommunicablediseasethatposesasignificantthreattothe community;andb)thatinanycaseallresidents mustbeaffordedalldueprocessrightsunderthelawsregardlessofany declaredstateofemergency; II.Thatnobusiness,entity,school,orcountyorcitydepartmentintheCounty shallrequireanypersontoreceiveavaccination,orberequiredtoshowproof ofavaccination,asaconditionofemployment,education,ortoreceive service; III.Thatnobusiness,entity,ororganizationintheCountyshallrequireany persontodonafacialcoveringinordertoenteraplaceofbusinessortobe servedatthesame; IV.Thatindividualshavearighttoandareencouragedtomakemedical decisionswiththeirowninformedconsent,inconcertwiththemedical providerofhisorherchoosing,andhavetherighttomaintaintheirprivacy regardingsaiddecisions,andnobusiness,entity,ororganizationshallinterfere withtheserightsinanyway; V.Thatnowastewaterepidemiologysurveillanceorgenetictestingshallbe allowedtotakeplacethatviolatestheconstitutionallyprotectedrightsof citizensagainstinvasionoftheirprivacyortheirrighttobefreefromsearches orseizureswithoutawarrantorcourtorder. BEITFURTHERRESOLVED,bytheBoardofSupervisors,CountyofButte, StateofCalifornia,thatinresponsetothisdeclaration,thefollowingshalltake effectimmediately: I.TheCountyshallissuenomaskorfacecoveringmandate,norshallitenforce orallowtobeenforcedanymaskorfacecoveringmandatesissuedbyoutside agency; II.Allsignagerequiringmasksorfacecoveringsshallberemovedfromall Countypropertyandfacilities; II.AllresidentswithintheCounty,aswellasCountyemployees,are empoweredtomaketheirowndecisionsregardingwhetherornottoweara facecovering,andtheCountyshallnotinanywayinterferewithoroverride theirindividualdecision; IV.TheCountyshallnottreatanypersonsintheCountydifferentlybasedon theirvaccinationstatus; V.TheCountyshallrequireallmedicalprovidersoperatingwithintheCounty totakeallstepsnecessarytoprovidetotheirpatientsinformationpursuantto anyEmergencyUseAuthorizationinregardstovaccinesorothermedications sothattheirpatientsmaymakeinformedmedicaldecisionsabouttheir healthcare. VI.TheCountyshallcausetobemadepublicandnotoriousthisResolutionto allinhabitantsandbusinesswithinthecountybywhatevermeansaswill effectuateitsnotice; BEITFURTHERRESOLVED,bytheBoardofSupervisors,CountyofButte, StateofCalifornia,thatinanefforttoalleviatetheeconomicdamageresulting fromenforcementoftheGovernor’s“emergencyorders,”theCountyshall establishan“EconomicReliefFund”forsmallandmedium-sizedbusinesses thathaveincurredexpensesorlostrevenueduetotheGovernor’semergency directivesintheformoffines,penalties,legalfees.Thefundshallbecreated fromtheCounty’sGeneralFundorfromany“COVIDReliefFunds”received bytheCountyfromthefederalgovernmentinanamountthatiscalculatedto coverasmanyclaimsascanbeexpectedtobefiledandshallbedisbursedona firstcome,firstservedbasisbytheBoardofSupervisors.Thoseseeking reimbursementfromtheFundshallsubmitproofoftheirexpensestotheButte CountyClerkoftheBoardwho,inturn,willplaceanactionitemforthe proposedreimbursementontheagendaofthenextregularmeetingofthe BoardofSupervisors.TheBoardofSupervisorsshallretainuntoitselfthesole discretiontoawardreimbursementsbaseduponfactspresentedtoitbyeach applicant.
