WHEREAS,ButteCountyisasubdivisionoftheStateof California,andmaymakelawstopreservethepublichealth, safetyandwelfareofthoseintheCounty;and WHEREAS,TheBoardofSupervisorsfindsthatButteCounty recognizestherightofitsresidentstomakemedicaldecisions forthemselvesandtheirminorchildren,inaccordancewith theirpersonaland/orreligiousbeliefs;and WHEREAS,ButteCountyBoardofSupervisorsrecognizes everypatient’srighttorefusemedicaltreatmentandtherightto retainhisorherprivacyconcerningtheirmedicalcare;and WHEREAS,boththeUnitedStatesConstitutionandthe ConstitutionoftheStateofCaliforniaprohibitinfringementon privacy,religiousliberty,andunlawfulsearchesandseizures. NOWTHEREFOREBEITRESOLVED,bytheBoardof Supervisors,CountyofButte,StateofCalifornia,thatnoentity shallestablishavaccinerequirementorproofofvaccine requirementtoenjoyanybenefitorexerciseanyrightheldby citizensofButteCounty. BEITFURTHERRESOLVED,bytheBoardofSupervisors, CountyofButte,StateofCalifornia,thatinresponsetothis resolution,thefollowingshalltakeeffectimmediately: I.CaliforniaHealthandSafetyCode120175.5shallneverbe interpretedtoa)permitthePublicHealthOfficertoremove citizensofButteCountyfromtheirresidencesunderany circumstanceunlessthatcitizen’sprimarycarephysicianora physicianoftheirownselectiondeterminesthatsaidresidentis currentlyinfectedwithacommunicablediseasethatposesa significantthreattothecommunity;andb)thatinanycaseall residents mustbeaffordedalldueprocessrightsunderthelawsregardless ofanydeclaredstateofemergency; II.Thatnobusiness,entity,school,orcountyorcitydepartment intheCountyshallrequireanypersontoreceiveavaccination, orberequiredtoshowproofofavaccination,asaconditionof employment,education,ortoreceiveservice; III.Thatnobusiness,entity,ororganizationintheCountyshall requireanypersontodonafacialcoveringinordertoentera placeofbusinessortobeservedatthesame; IV.Thatindividualshavearighttoandareencouragedtomake medicaldecisionswiththeirowninformedconsent,inconcert withthemedicalproviderofhisorherchoosing,andhavethe righttomaintaintheirprivacyregardingsaiddecisions,andno business,entity,ororganizationshallinterferewiththeserights inanyway; V.Thatnowastewaterepidemiologysurveillanceorgenetic testingshallbeallowedtotakeplacethatviolatesthe constitutionallyprotectedrightsofcitizensagainstinvasionof theirprivacyortheirrighttobefreefromsearchesorseizures withoutawarrantorcourtorder. BEITFURTHERRESOLVED,bytheBoardofSupervisors, CountyofButte,StateofCalifornia,thatinresponsetothis declaration,thefollowingshalltakeeffectimmediately: I.TheCountyshallissuenomaskorfacecoveringmandate,nor shallitenforceorallowtobeenforcedanymaskorface coveringmandatesissuedbyoutsideagency; II.Allsignagerequiringmasksorfacecoveringsshallbe removedfromallCountypropertyandfacilities; II.AllresidentswithintheCounty,aswellasCounty employees,areempoweredtomaketheirowndecisions regardingwhetherornottowearafacecovering,andthe Countyshallnotinanywayinterferewithoroverridetheir individualdecision; IV.TheCountyshallnottreatanypersonsintheCounty differentlybasedontheirvaccinationstatus; V.TheCountyshallrequireallmedicalprovidersoperating withintheCountytotakeallstepsnecessarytoprovidetotheir patientsinformationpursuanttoanyEmergencyUse Authorizationinregardstovaccinesorothermedicationssothat theirpatientsmaymakeinformedmedicaldecisionsabouttheir healthcare. VI.TheCountyshallcausetobemadepublicandnotoriousthis Resolutiontoallinhabitantsandbusinesswithinthecountyby whatevermeansaswilleffectuateitsnotice; BEITFURTHERRESOLVED,bytheBoardofSupervisors, CountyofButte,StateofCalifornia,thatinanefforttoalleviate theeconomicdamageresultingfromenforcementofthe Governor’s“emergencyorders,”theCountyshallestablishan “EconomicReliefFund”forsmallandmedium-sizedbusinesses thathaveincurredexpensesorlostrevenueduetothe Governor’semergencydirectivesintheformoffines,penalties, legalfees.ThefundshallbecreatedfromtheCounty’sGeneral Fundorfromany“COVIDReliefFunds”receivedbythe Countyfromthefederalgovernmentinanamountthatis calculatedtocoverasmanyclaimsascanbeexpectedtobe filedandshallbedisbursedonafirstcome,firstservedbasisby theBoardofSupervisors.Thoseseekingreimbursementfrom theFundshallsubmitproofoftheirexpensestotheButte CountyClerkoftheBoardwho,inturn,willplaceanaction itemfortheproposedreimbursementontheagendaofthenext regularmeetingoftheBoardofSupervisors.TheBoardof Supervisorsshallretainuntoitselfthesolediscretiontoaward reimbursementsbaseduponfactspresentedtoitbyeach applicant.
