Encourage your Butte County elected representative to adopt this resolution at the Butte County Board of Supervisor Meeting on Tuesday July 20th Email the Clerkoftheboard@ButteCounty.net asking the Clerk of the Board to pass this information to the Board of Supervisors. Encourage your elected representatives to read this resolution and adopt this Resolution: Prohibiting Any Entity From Establishing a Vaccine Requirement or Proof of Vaccine Requirement to Enjoy Any Benefit or Exercise Any Right By Residents of Butte County Before the Board of Supervisors County of Butte, State of California In the matter of: RESOLUTION NO. 2021-XX A resolution of the Butte County Board of Supervisors prohibiting any entity from establishing a vaccine requirement or proof of vaccine requirement to enjoy any benefit or exercise any right by residents of Butte County. WHEREAS, Butte County is a subdivision of the State of California, and may make laws to preserve the public health, safety and welfare of those in the County; and WHEREAS, The Board of Supervisors finds that Butte County recognizes the right of its residents to make medical decisions for themselves and their minor children, in accordance with their personal and/or religious beliefs; and WHEREAS, Butte County Board of Supervisors recognizes every patient’s right to refuse medical treatment and the right to retain his or her privacy concerning their medical care; and WHEREAS, both the United States Constitution and the Constitution of the State of California prohibit infringement on privacy, religious liberty, and unlawful searches and seizures. NOW THEREFORE BE IT RESOLVED, by the Board of Supervisors, County of Butte, State of California, that no entity shall establish a vaccine requirement or proof of vaccine requirement to enjoy any benefit or exercise any right held by citizens of Butte County. BE IT FURTHER RESOLVED, by the Board of Supervisors, County of Butte, State of California, that in response to this resolution, the following shall take effect immediately: I. California Health and Safety Code 120175.5 shall never be interpreted to a) permit the Public Health Officer to remove citizens of Butte County from their residences under any circumstance unless that citizen’s primary care physician or a physician of their own selection determines that said resident is currently infected with a communicable disease that poses a significant threat to the community; and b) that in any case all residents must be afforded all due process rights under the laws regardless of any declared state of emergency; II. That no business, entity, school, or county or city department in the County shall require any person to receive a vaccination, or be required to show proof of a vaccination, as a condition of employment, education, or to receive service; III. That no business, entity, or organization in the County shall require any person to don a facial covering in order to enter a place of business or to be served at the same; IV. That individuals have a right to and are encouraged to make medical decisions with their own informed consent, in concert with the medical provider of his or her choosing, and have the right to maintain their privacy regarding said decisions, and no business, entity, or organization shall interfere with these rights in any way; V. That no wastewater epidemiology surveillance or genetic testing shall be allowed to take place that violates the constitutionally protected rights of citizens against invasion of their privacy or their right to be free from searches or seizures without a warrant or court order. BE IT FURTHER RESOLVED, by the Board of Supervisors, County of Butte, State of California, that in response to this declaration, the following shall take effect immediately: I. The County shall issue no mask or face covering mandate, nor shall it enforce or allow to be enforced any mask or face covering mandates issued by outside agency; II. All signage requiring masks or face coverings shall be removed from all County property and facilities; II. All residents within the County, as well as County employees, are empowered to make their own decisions regarding whether or not to wear a face covering, and the County shall not in any way interfere with or override their individual decision; IV. The County shall not treat any persons in the County differently based on their vaccination status; V. The County shall require all medical providers operating within the County to take all steps necessary to provide to their patients information pursuant to any Emergency Use Authorization in regards to vaccines or other medications so that their patients may make informed medical decisions about their healthcare. VI. The County shall cause to be made public and notorious this Resolution to all inhabitants and business within the county by whatever means as will effectuate its notice; BE IT FURTHER RESOLVED, by the Board of Supervisors, County of Butte, State of California, that in an effort to alleviate the economic damage resulting from enforcement of the Governor’s “emergency orders,” the County shall establish an “Economic Relief Fund” for small and medium-sized businesses that have incurred expenses or lost revenue due to the Governor’s emergency directives in the form of fines, penalties, legal fees. The fund shall be created from the County’s General Fund or from any “COVID Relief Funds” received by the County from the federal government in an amount that is calculated to cover as many claims as can be expected to be filed and shall be disbursed on a first come, first served basis by the Board of Supervisors. Those seeking reimbursement from the Fund shall submit proof of their expenses to the Butte County Clerk of the Board who, in turn, will place an action item for the proposed reimbursement on the agenda of the next regular meeting of the Board of Supervisors. The Board of Supervisors shall retain unto itself the sole discretion to award reimbursements based upon facts presented to it by each applicant.
