HomeMy WebLinkAboutB21-2388 065-400-041 Variance Request Chris Boyd Fire Captain CAL FIRE - Butte County Fire Department 176 Nelson Avenue Oroville, CA 95965 RE: APN 065-400-041, BUILDING PERMIT B21-2388 15078 Jack Pine Way, Magalia FIRE SAFE REGULATIONS VARIANCE REQUEST Captain Boyd, We humbly ask you to provide a variance to the 2020 California Board of Forestry and Fire protection SRA Fire Safe Regulations section 1276.01. Attached is a proposed site plan providing additional detail to clarify the requested variance. With the size of the property, existing garage and septic system plus being a corner lot, and the new 30 foot setback, it would make us unable to build a new home on the property. On the attached site plan I have proposed a new residential structure with un-attached garage that would have portions placed 5 feet from the west property line and 30 feet from the south property line. To mitigate fire concerns, I have cleared at the property of all hazardous trees and will create and maintain defensible space. Additional mitigations providing same practical effect as the SRA set back include; installation of double glazed windows in both master and second bathroom and installation of metal fencing on the side 5 ft from the property line. Section 1276.01 states that all parcels must provide a minimum 30 foot setback for buildings and accessory buildings is required. Unfortunately due to the restrictions noted above, that would limit the buildable area significantly. I do thoroughly understand and have great appreciation for defensible space and will ensure that this proposed variance does not present an additional fire hazard or risk.
