HomeMy WebLinkAbout21-075RESOLUTION TO OPT OUT OF AB 1976WITH THE CALIFORNIA DEPARTMENT OFHEALTHCARE SERVICES WHEREAS, with the passage of Assembly Bill 1976, the California Department of Health Care Services has presented Butte County Department of Behavioral with the opportunity to immplement Assembly Bill 1421, "Laura's Law," which authorizes court-ordered intensive outpatient treatment of adults with a severe mental illness who refuse voluntary treatment, and their conditions are deteriorating substantially. To qualify for Laura's Law, the individual must meet the following criteria: 1. The person is 18 years of age or older. 2. The person issuffering from e mental illness, as defined as: a mental disorder that is severe in degree and persistent in duration, which may ca:use behaviors which substantially interfere with the primary activities of daily living, aimd which may result in an lnabiUltyto maintain independent functioning without treatment, support, and rehabilitation for along orindefinite period nftime. 3. There has been a clinical determination that the person is unlikely to survive safely in the community without supervision. 4. The person has a history of lack of compliance with treatment for the person's mental illness, imatleast one of the following: A. The person's mental illness has, at least twice within the last 36 months, been a substantial factor in necessitating psychiatric hospitalization, or receipt ofservices in a forensic or other mental health unit of state correctional facility ur local correctional facility. B. The person's mental illness has resulted in one or more acts of serious and violent behaviortoward themselves or another or threats, or attempts to cause serious physical harm to themselves or another within the last 48 months; and WHEREAS, the Butte County Behavioral Health Department recommends that the County opt out of the AB 1976 legislation; July 1,28Z1; and WHEREAS, Butte County Department of Behavioral Health intends to apply for Mental Health Services Act (MHSA) Innovation funding to establish an outreach and engagement program that incorporates components of an Assisted Outpatient Treatment (AOT) program.
