A ESOL It T I OR BT T A E BOA I! )":71#711,"� EXISTENCE OF A LOCAL STATE OF EMERGENCY DUE TO DROUGHT CONDITIONS WHEREAS, California Government Code sections 58,85 and 8630 empower the Board of Supervisors to proclaim the existence of a local emergency when Butte County is threatened or likely to be threatened by the conditions of extreme peril to the safety of persons and property that are or are likely to be beyond the control of the services, personnel, equipment, and facilities of this county; and WHEREAS, rainfall totals and water storage supply have been critically low, resulting in a need for increased water storage, water distribution, public ed�ucation, and a stop to water theft; and WHEREAS, extraordinarily warm temperatures have worsened this critically dry year for the State of California, accelerating the already limited snow melt in the Sacramento, Feather and American River watersheds, reducing expected water supplies by more than 500,000 -acre feet ; and WHEREAS, on March 5, 2021, the Secretary of the United States Department of Agriculture designated California's 58 counties as a primary natural disaster area due to recent drought; and WHEREAS, on April 21, 2021 the Governor of the State of California Proclaimed a State of Emergency to exist in two California counties due to the current and potential impacts caused by the widespread drought conditions and on May 10, 2021 expanded the Declaration of Emergency to include a, total of 41 counties, including Butte County; and WHEREAS, the drought poses significant economic, environmental, health, welfare and social impacts and an imminent threat to the County's citizens, businesses, agriculture, property, communities, wildlife and recreation. NOW, THEREFORE, BE IT RESOLVED AND ORDERED that the Butte County Board of Supervisors hereby proclaims Butte County to be a disaster area and that a Local State of Emergency exists due to drought conditions throughout Butte County; and IT IS FURTHER RESOLVED AND ORDERED that the County of Butte requests the State of California to waive regulations that may hinder response and recovery efforts, make available assistance under the California Disaster Assistance Act or any other state funding, and to expedite access to federal resources and any other appropriate federal disaster relief programs (e.g. SBA funding, etc.); and IT IS FURTHER RESOLVED AND ORDERED that the Proclamation of the existence of a Local State of Emergency due to drought conditions described above shall be deemed to continue to exist until it's termination; and IT IS FURTHER RESOLVED AND ORDERED that during the existence of said Local Emergency the powers, functions and duties of the emergency organization of this County shall be those prescribed by state law, by charter, ordinances, and resolutions of this County, and by the County of Butte Emergency Plan; and IT IS FURTHER RESOLVED AND ORDERED that a copy of this resolution be forwarded to the Director of the Governor's Office of Emergency Services.
