Good evening, board members. In response to this email, I wanted to provide you all with a
response from our Deputy Director (Craig Cissell) out at the landfill.

The information regarding new leachate seeps at Neal Road Landfill that was recently
provided to the BOS from COL was misrepresented. As part of our permit conditions, Neal
Road staff are required to immediately report any damage or changes to the landfill as a result
of storms to the Water Board as well as a follow-up report documenting repairs within 14 days
of the original notification. This information is uploaded to a public database, which
immediately becomes public information. As Neal Road Landfill received considerable rain
from the atmospheric river event, the rills and seeps that formed are normal occurrences from
receiving this large of a volume of precipitation and are not entirely preventable. We had all of
our best management practices in place before the storm. Many of these worked well, while a
few required additional attention for improvement. We are required to report impacts to the
site after significant storm events (1” in 24-hrs) and also to report seeps. With drier weather,
we are making on-site corrections. These corrections are considered minor.
We are not aware of any actions that would expose us to a possible Notice of Violation from
the Water bOARD as we are following all proper procedures for notification and repair.

Dear Board of Supervisors,
As you will see, you are being misled. Storm water runoff continues to be a significant
problem at the NRRWF. This is why there are two pending lawsuits, and why COL will
prevail. Please don’t waste anymore tax dollars on a futile legal battle. As a matter of
principle, address the issue at hand.
