Daneluk, AICP, Director Curtis Johnson, Assistant Director 7 County Center Drive T: 530.552.7601 Oroville, California 95965 F: 530.538.7785 December 15, 2021 Mr. Rob Haley 3415 Peerless Lane Chico, CA 95973 Subject: BCALUC Consistency Review (A21-0004) of a proposed 4 lot tentative parcel map on APN: 047-780-013 Dear Mr. Haley: On December 15, 2021, the Butte County Airport Land Use Commission (BCALUC) held a consistency review hearing for the proposed project, a 4 lot tentative parcel map, within both B2 and C Compatibility Zones of the Chico Municipal Airport. The normal maximum density allowed in the B2 Compatibility Zone is 0.2 dwelling units per acre, while in the C Compatibility Zone the density is either 0.2 dwelling units per acre or 4 or more per acre. The project’s proposed density is 0.67 dwelling units per acre. Based on the project’s density, the BCALUC found the referenced project to be inconsistent with the Butte County Airport Land Use Compatibility Plan based on the following: 1. The proposed project residential density (0.67 dwelling units per acre) of the project is not consistent with the portion of the project site within Compatibility Zone B2 which requires a density of less than or equal to 0.2 dwelling units per acre. The BCALUC did identify that the portion within Compatibility Zone C was compatible with the density requirements of the Butte County Airport Land Use Compatibility Plan, but not with Compatibility Zone B2. They did review and discuss the findings provided for a compatibility determination due to special circumstances, but determined the findings could not be made. Although you identified that you would not be moving forward with the project, if you decide to proceed with the proposed land division, please submit in the application materials for a tentative parcel map and it will go through a public hearing process to the Planning Commission. But in order for the project to be approved, an overrule will need to be approved by the Board of Supervisors. The overrule will require findings to be consistent with the purposes of Article 3.5 of Chapter 4 of the State Aeronautics Act as stated in Section 21670 of the Public Utilities Code ("PUC").
