Board Members,
Staff looked into Mr. Merkel’s statements and found that the well at Sierra Nevada is legal, and that
the company went above and beyond on every step with this well. Additionally, staff reviewed the
CEQA documentation and did not find any gaps in compliance.

I’m asking to supervisors to agendise an investigation into Sierra Nevada Illegal well on their
property.
Then issue violation on expanded facilities and the need for a new CEQA study.
